{"data":{"id":"us-ky/krs-45.240","jurisdiction":"us-ky","citation":"KRS 45.240","heading":"Treatment of erroneous payments recovered within 60 days of identification","body":"-- KRS 45.237 and 45.238 applicable to erroneous payments recovered after 60\ndays.\n(1) Whenever any payment from public money is made in error, or for an amount in\nexcess of the  amount found to be properly due and payable, and the payment or\nexcess amount is recovered within sixty (60) days from the date the erroneous or\nexcess payment was identified, the funds shall be allocated to the fund from which\nthe improper payment was ex pended, the balance in the appropriation from which\nthe payment was made shall be increased by the amount recovered, and the amount\nrecovered shall be deducted from the disbursements from that appropriation.\n(2) If the payment or excess amount which is lat er recovered is in the form of an\nunnegotiated State Treasurer's check, said check shall be transmitted direct to the\nState Treasurer who shall void it. After voiding the check, the State Treasurer shall\nnotify the appropriate agency of the action taken concerning the check.\n(3) Whenever any payment from public money is made in error, or for an amount in\nexcess of the amount found to be properly due and payable, and the payment or\nexcess amount is recovered after sixty (60) days from the date the erroneous or\nexcess payment was identified, the provisions set forth in KRS 45.237 and 45.238\nshall apply, and the funds shall be allocated as provided in those sections.","path":["KRS Chapter 45"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=22210","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:04Z","sha256":"5c51d4d0ed3ecaeb14e1365b1db6e791f0e3df5a4c7b2c12eca27f484f602728","source_id":"us-ky","stale":false,"prev":"us-ky/krs-45.239","next":"us-ky/krs-45.241"},"notice":"GroundRules: Original legal text.
