{"data":{"id":"us-ky/krs-45.253","jurisdiction":"us-ky","citation":"KRS 45.253","heading":"Revolving, trust, or agency accounts -- Charges for services by agencies.","body":"(1) Revolving accounts may be established by appropriation in a branch budget bill to\nfinance activities which are self-supporting in whole or in part.\n(2) Trust and agency accounts may be established by a branch budget bill to receive and\ndisburse contrib utions, gifts, donations, devises, and federal appropriations, and,\nwhen authorized by law, by depositing all of the fees (which include fees for\nmaintenance in state institutions, incidental fees, tuition fees, fees for board and\nroom, athletics, and stud ent activities), rentals, admittance, sales, licenses collected\nby law, subventions, and other miscellaneous receipts of budget units.\n(3) The head of the budget unit or other responsible fiscal agent of the unit for which a\nrevolving, trust, or agency account has been established shall deposit with the State\nTreasury all receipts of the character above described, and the Finance and\nAdministration Cabinet shall credit all receipts to the budget unit and shall keep\nseparate accounting for each account so established.\n(4) The amounts credited to any revolving, trust, or agency account so provided, shall\nbe held available for disbursement for the purpose provided by law and shall not be\ndiverted to any other purpose. Revolving, trust, or agency accounts shall be subject\nto withdrawal from the State Treasury by the head of each budget unit when actually\nneeded, on requisition to the Finance and Administration Cabinet in the same\nmanner provided by law as other state funds are withdrawn. Funds received from\nthe federal government in the form of grants or otherwise may be expended for the\npurpose intended even though received in a fiscal year other than that in which the\nrelated original encumbrance or expenditure was incurred. Trust and agency funds\nshall be allotted before an expenditure is made; and the secretary of the Finance and\nAdministration Cabinet may withhold allotment of general fund appropriations to\nthe extent trust and agency funds are available.\n(5) Subject to prior approval by the secretary of the F inance and Administration\nCabinet, the Chief Justice, and the Legislative Research Commission for their\nrespective branches, any budget unit which, as an incident to its authorized duties\nand functions, furnishes requested services or materials to any pers ons outside state\ngovernment, where such services or materials are not required by law to be\nfurnished gratuitously, may charge such persons an amount not to exceed the total\nexpense to the budget unit of the services or materials furnished. The receipts f rom\nthe approved charges shall be credited to the surplus account of the general fund.\nPayroll deductions for the Department of Kentucky State Police legal fund shall be\nmade without any service fees or charges.\n(6) The Commonwealth Office of Technology ma y charge any agency of local\ngovernment an amount, not to exceed the total expense to the department, for\nservices rendered or materials furnished at the request of the local government\nagency, unless the services or materials are required by law to be fur nished\ngratuitously. The receipts from the authorized charges shall be deposited in the State\nTreasury and credited to the trust and agency fund, the Commonwealth Office of\nTechnology's operating account.\n(7) All receipts which accrue as the result of the Commonwealth Office of\nTechnology's providing on -line computer access to public records by\nnongovernment entities shall be deposited in the State Treasury and credited to the\ntrust and agency fund, the Commonwealth Office of Technology's operating\naccount.","path":["KRS Chapter 45"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=22222","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:04Z","sha256":"661ca25397980f045b58cc5fab0ecd29f3afd9dbed17a9164348cac862450cc9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-45.252","next":"us-ky/krs-45.255"},"notice":"GroundRules: Original legal text.
