{"data":{"id":"us-ky/krs-45.620","jurisdiction":"us-ky","citation":"KRS 45.620","heading":"Action against contractor -- Hiring of minority or woman contractor or","body":"subcontractor.\n(1) The Finance and Administration Cabinet may investigate the employment practices\nof any contractor or subcontractor to determine if any of the provisions of KRS\n45.560 to 45.640 have been violated. If any contractor is found by the cabinet to\nhave engaged in an unlawful practice under KRS 45.560 to 45.640 during the\ncourse of performing under a contract or subcontract covered under KRS 45.560 to\n45.640, the cabinet shall so certify to the contracting agency and such certification\nshall be binding upon the contracting agency unless it is reversed in the course of\njudicial review.\n(2) If the contractor is found to have committed an unlawful practice under KRS 45.560\nto 45.640, the contracting agency may cancel or terminate the contract, conditioned\nupon a program for future compliance approved by the contracting agency and the\ncabinet. The contracting agency may declare such a contractor ineligible to bid on\nfurther contracts with that agency until such time as the contractor complies in full\nwith the requirements of KRS 45.560 to 45.640.\n(3) The equal employment provisions of KRS 45.560 to 45.640 may be met in part by a\ncontractor by subcontracting to a minority or woma n contractor or subcontractor.\nFor the provisions of KRS 45.560 to 45.640, a minority or woman contractor or\nsubcontractor shall mean a business that is owned and controlled by one (1) or more\npersons disadvantaged by racial, ethnic, or gender circumstances.","path":["KRS Chapter 45"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=22289","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:05Z","sha256":"7923f3313441ebde061cccf1e296bb7d730a9ce7052b7f7854503e4b2e3c0763","source_id":"us-ky","stale":false,"prev":"us-ky/krs-45.610","next":"us-ky/krs-45.630"},"notice":"GroundRules: Original legal text.
