{"data":{"id":"us-ky/krs-45.782","jurisdiction":"us-ky","citation":"KRS 45.782","heading":"Statewide deferred maintenance fund.","body":"(1) There is created within the capital construction fund the \"Statewide Deferred\nMaintenance Fund\". The fund shall be used as a supplemental source for funding\ndeferred maintenance and government mandate needs of state agencies.\nMaintenance includes equipment  used primarily for maintenance purposes and\nexpenditures related to deferred maintenance of infrastructure and capital assets.\nThe balance of any moneys remaining in the fund at the close of any fiscal year\nshall not lapse but shall be carried forward to the next fiscal year.\n(2) Priority for the funding from the statewide deferred maintenance fund shall be\ndetermined by the secretary of the Finance and Administration Cabinet in\nconsultation with the state budget director and the commissioner of the Depar tment\nfor Facilities Management. State agencies that do not have separate agency -specific\nmaintenance funds or that have inadequate maintenance funds shall be given\npriority for access to moneys in the statewide deferred maintenance fund.\n(3) Moneys from the statewide deferred maintenance fund shall not be expended for:\n(a) New capital projects; or\n(b) Additional funding for any capital project that received line item authorization\nby the General Assembly in any branch budget bill.\n(4) The secretary shall, by September 1 of each year, report to the Legislative Research\nCommission all transfers from the fund, including the purpose and amount of each\ntransfer and the amount of funds carried forward for the fiscal year ending on June\n30 of that year.","path":["KRS Chapter 45"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=22309","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:06Z","sha256":"270ed02dd5996be5e020d731e6794e758d2e27e457e280d04899a20fe97bed4f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-45.780","next":"us-ky/krs-45.790"},"notice":"GroundRules: Original legal text.
