{"data":{"id":"us-ky/krs-45.795","jurisdiction":"us-ky","citation":"KRS 45.795","heading":"Determinations to be made in reviewing projects -- Request for Legislative","body":"Research Commission to seek injunction.\n(1) In reviewing a project, the committee shall determine whether the project has met\nall the relevant requirements of:\n(a) KRS 45.750 to 45.816;\n(b) KRS 56.800 to 56.823; and\n(c) Any other statutes relating to the committee's oversight of:\n1. Capital projects;\n2. The allotment and expenditure of funds from the emergency repair,\nmaintenance, and replacement account and the capital cons truction and\nequipment purchase contingency account;\n3. The state's acquisition of capital assets, including the lease of real\nproperty;\n4. The issuance of bonds by the Commonwealth, and the related individual\nprojects; and\n5. Bonds issued by or on behalf of local school districts.\n(2) If the committee determines that any of the requirements in subsection (1) of this\nsection have not been met, the committee may, by majority vote, request that the\nLegislative Research Commission file a civil court proceeding to seek an injunction\nto prohibit further action on the capital project, the acquisition of the capital asset,\nthe initiation or modification of the lease of real property, the bond issue, or the\nallotment or expenditure of fu nds from the capital construction emergency or\ncontingency accounts.\n(3) The committee may take action requesting the Legislative Research Commission to\nseek an injunction before, during, or after its compliance with the provisions of\nKRS 45.800(2) or KRS 45.810(3), where applicable.","path":["KRS Chapter 45"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=22313","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:06Z","sha256":"8b41e4b9acfa2373db199b802c400858214abf0daa4db8d4ee8fc30a8ce1852e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-45.794","next":"us-ky/krs-45.800"},"notice":"GroundRules: Original legal text.
