{"data":{"id":"us-ky/krs-45.850","jurisdiction":"us-ky","citation":"KRS 45.850","heading":"Appropriations for capital construction, operating budget, regulating, and","body":"monitoring of nuclear waste disposal site.\n(1) Appropriations for the capital construction and for the operating budget of a nuclear\nwaste disposal site owned by the Commonwealt h shall be set forth as a major\nprogram cost in the executive budget document for the Energy and Environment\nCabinet.\n(2) Appropriations for the regulating and monitoring of a nuclear waste disposal site\nowned by the Commonwealth shall be set forth as a ma jor program cost in the\nexecutive budget document for the Cabinet for Health and Family Services.\nMonitoring and water sampling and analyses shall be maintained and budgeted for\nat a level to provide frequent and continuing evidence of the safety of the site.\n(3) Operating costs associated with the daily maintenance of the site in excess of\nallocations budgeted to the Energy and Environment Cabinet, regulating and\nmonitoring costs associated with normal surveillance of the site in excess of\nallocations budg eted to the Cabinet for Health and Family Services, and costs\nassociated with an emergency at the site so declared by the Governor shall be\ndeemed necessary governmental expenses.\n(4) In the event a request for funds is made pursuant to subsection (3) of t his section, a\ncopy of the request and the justification for additional funds shall be forwarded to\nthe office of the Legislative Research Commission and to the Governor at the time\nthe request is made but no later than fifteen (15) days prior to the actual expenditure\nof additional funds. The Legislative Research Commission or its designated\nsubcommittee may request further explanation of the need for additional funds.\n(5) Subsections (3) and (4) of this section shall apply only to sites located in the\nCommonwealth prior to July 15, 1980.","path":["KRS Chapter 45"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=22320","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:06Z","sha256":"3c94f18e49b27aa1620e2c652fed2abf4adcca46eaab8fc4e61d759919a11365","source_id":"us-ky","stale":false,"prev":"us-ky/krs-45.818","next":"us-ky/krs-45.990"},"notice":"GroundRules: Original legal text.
