{"data":{"id":"us-ky/krs-45.990","jurisdiction":"us-ky","citation":"KRS 45.990","heading":"Penalties.","body":"(1) Any officer, agent, or employee of any budget unit who willfully fails or refuses to\ncomply with any of the provisions of KRS 45.011 to 45.031, 45.121, 45.142,\n45.151, 45.242, 45.244, 45.251, 45.253, 45.305, or 45.313, or who expends any\nmoney in violation  of any of the provisions of those sections, shall be subject to\nprosecution in the Franklin Circuit Court, and upon conviction shall be guilty of a\nviolation.\n(2) If any person incurs, or orders or votes for the incurrence of, any obligations in\nviolation of any of the provisions of KRS 45.244, he and his sureties shall be jointly\nand severally liable therefor.\n(3) Any employee of the Office of Material and Procurement Services established\nwithin the Office of the Controller, or any official of the Commonw ealth of\nKentucky, elective or appointive, who shall take, receive, or offer to take or receive,\neither directly or indirectly, any rebate, percentage of contract, money, or other\nthings of value, as an inducement or intended inducement in the procurement of\nbusiness, or the giving of business, including, but not limited to, personal service\ncontracts, for, or to, or from, any person, partnership, firm, or corporation, offering,\nbidding for, or in open market seeking to make sales to the Commonwealth of\nKentucky, shall be deemed guilty of a Class C felony.\n(4) Every person, firm, or corporation offering to make, or pay, or give, any rebate,\npercentage of contract, money, or any other thing of value, as an inducement or\nintended inducement, in the procurement  of business, or the giving of business,\nincluding, but not limited to, personal service contracts, to any employee of the\nOffice of Material and Procurement Services or to any official of the\nCommonwealth, elective or appointive, in his efforts to bid for , or offer for sale, or\nto seek in the open market, shall be deemed guilty of a Class C felony.","path":["KRS Chapter 45"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=22321","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:06Z","sha256":"1229d63e780e538f4b886ab6728037b8d2f04a2daa8c5143961cfab969df496e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-45.850","next":"us-ky/krs-45.991"},"notice":"GroundRules: Original legal text.
