{"data":{"id":"us-ky/krs-452.230","jurisdiction":"us-ky","citation":"KRS 452.230","heading":"Removal from county in state of lawlessness.","body":"(1) Whenever any Circuit Judge is satisfied from his own knowledge and from the\nwritten statement of the Commonwealth's attorney of that judicial circuit that such a\nstate of lawlessness exists in any county of his judicial circuit or that such a high\nstate of excitement or feeling of prejudice exists therein against the defendant that\nthere is apparent danger of mob violence in which loss of life or destruction of\nproperty may occur unlawfully, and that a trial in the county cannot be fairly and\nimpartially had, or that the officers of the court may be prevented from discharging\ntheir duty or the jurors intimidated or deterred from fairly and impartially rendering\na verdict in the case, he may order the action removed to some other county in\nwhich a fair trial can be had. The fiscal court of the county from which the removal\nis made shall pay out of the county treasury the costs of the removal.\n(2) A change of venue also may be had on motion of the defendant when the facts exist\nas set out in subsection (1). The  motion may be made by counsel, and the presence\nof the defendant in court shall be deemed to be waived upon the filing of the written\nstatement of his counsel as set forth in subsection (1) and the affidavit of the\ndefendant, which affidavit shall state t hat the defendant is in danger of mob\nviolence in the county and for that reason desires a change of venue to some other\ncounty, and that he thereby waives his presence on the hearing of the motion for a\nchange of venue.","path":["KRS Chapter 452"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=19489","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:57Z","sha256":"7adcac215ccb3cd5eb726c1933154e0e5291775359fd79656348ea7e5148687e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-452.220","next":"us-ky/krs-452.240"},"notice":"GroundRules: Original legal text.
