{"data":{"id":"us-ky/krs-454.280","jurisdiction":"us-ky","citation":"KRS 454.280","heading":"Individuals who can and cannot take depositions -- Penalty.","body":"(1) Depositions taken in the Commonwealth that are to be used in its courts shall be\ntaken before:\n(a) A hearing examiner;\n(b) A judge, clerk, commissioner, or official reporter of a court;\n(c) A notary public; or\n(d) Before other persons and under other circumstances authorized by law.\n(2) (a) A deposition shall not be taken by a person who is:\n1. A party to the action;\n2. A relative, employee, or attorney of one (1) of the parties;\n3. Someone with a financial interest in the action or its outcome; or\n4. A relative, employee, or attorney of someone with a financial interest in\nthe action or its outcome. For the purposes of this subparagraph,\n\"employee\" or \"relative\" shall not include an employee or relative of the\nattorney of one (1) of the parties.\n(b) For the  purposes of paragraph (a) of this subsection, \"employee\" includes a\nperson who has a contractual relationship with a person or entity interested in\nthe outcome of the litigation, including anyone who may ultimately be\nresponsible for payment to provide re porting or other court services, and a\nperson who is employed part -time or full-time under contract or otherwise by\na person who has a contractual relationship with a party to provide reporting\nor other court services.\n(c) If a deposition is taken by a person described in paragraph (a) of this\nsubsection, then that deposition shall be void.\n(3) The provisions of subsections (1) and (2) of this section shall not apply to contracts\nfor court reporting services for the courts, agencies, or instrumentalities of the\nUnited States or the Commonwealth.\n(4) Any person who takes a deposition in violation of subsection (2) of this section\nshall be guilty of a Class B misdemeanor.","path":["KRS Chapter 454"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=19608","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:58Z","sha256":"8139e63f6ca7ac0e15acfcb062b34d870a9e27e898edbaac8de0e06adfc48f01","source_id":"us-ky","stale":false,"prev":"us-ky/krs-454.275","next":"us-ky/krs-454.350"},"notice":"GroundRules: Original legal text.
