{"data":{"id":"us-ky/krs-454.435","jurisdiction":"us-ky","citation":"KRS 454.435","heading":"Jurisdiction of the Circuit Court -- Notice and hearing requirements --","body":"Nonwaiverability of KRS 454.430 to 454.435.\n(1) The Circuit Court in the county in which the original action was or could have been\nfiled, or the county where the applicant reside s, shall have jurisdiction over any\napplication for approval of a transfer of structured settlement payment rights under\nKRS 454.431.\n(2) Not less than twenty (20) days prior to the scheduled hearing on any application for\ncourt approval of a transfer of s tructured settlement payment rights under KRS\n454.431, the payee or transferee shall file with the court and serve on all protected\nparties a notice of the proposed transfer and the application for its approval,\nincluding in the notice:\n(a) A copy of the transferee's application to the court;\n(b) A copy of the disclosure statement required under KRS 454.431(2); and\n(c) Notification of the time and place of the hearing and notification of the\nmanner in which and the time by which written responses to the app lication\nmust be filed, which shall be not less than ten (10) days after service of the\ntransferee's notice, in order to be considered by the court.\n(3) The provisions of KRS 454.430 to 454.435 may not be waived.","path":["KRS Chapter 454"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=19616","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:58Z","sha256":"a4a87cb074dfd386816d8ac8b774f00ef373f075fc21475c2f20e5c49b6427a8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-454.431","next":"us-ky/krs-454.450"},"notice":"GroundRules: Original legal text.
