{"data":{"id":"us-ky/krs-455.180","jurisdiction":"us-ky","citation":"KRS 455.180","heading":"Arrest or search warrant authorizing entry without notice -- Requirements","body":"for issuance.\nNo arrest warrant or search warrant shall be issued authorizing entry without notice\nunless:\n(1) The court finds by clear and convincing evidence that:\n(a) The crime alleged is a crime that would qualify a person, if convicted, as a\nviolent offender under KRS 439.3401; the crime alleged is a crime designated\nin KRS 525.045, 527.200, 527.205, or 527.210; or the evidence sought may\ngive rise to the charge of a crime that would qualify a person, if convicted, as\na violent offender under KRS 439.3401 or may give rise to a charge of a crime\ndesignated in KRS 525.045, 527.200, 527.205, or 527.210; and\n(b) As established by facts specific to the case, giving notice  prior to entry will\nendanger the life or safety of any person, or result in the loss or destruction of\nevidence sought that may give rise to a charge of a crime that would qualify a\nperson, if convicted, as a violent offender under KRS 439.3401 or may giv e\nrise to a charge of a crime designated in KRS 525.045, 527.200, 527.205, or\n527.210;\n(2) The law enforcement officer seeking the warrant has obtained the approval of his or\nher supervising officer, or has the approval of the highest ranking officer in hi s or\nher law enforcement agency;\n(3) The law enforcement officer seeking the warrant has consulted with the\nCommonwealth's attorney or county attorney for the jurisdiction for which the\nwarrant is sought, or with an assistant Commonwealth's attorney or ass istant county\nattorney for the jurisdiction for which the warrant is sought;\n(4) The law enforcement officer seeking the warrant discloses to the judge, as part of\nthe application, any other attempt to obtain a warrant authorizing entry without\nnotice for the same premises, or for the arrest of the same individual;\n(5) The warrant authorizes that the entry without notice occur only between the hours\nof 6 a.m. and 10 p.m., except in exigent circumstances where the court makes the\nfindings set forth in subsection (1) of this section and the court further finds by clear\nand convincing evidence that there are substantial and imminent risks to the health\nand safety of the persons executing the warrant, the occupants of the premises, or\nthe public that justify the  entry without notice occur during other hours designated\nby the court; and\n(6) If the warrant is not issued electronically pursuant to KRS 455.170, the warrant\nincludes the legibly printed name and signature of the judge.","path":["KRS Chapter 455"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51735","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:58Z","sha256":"86b066e36e309da6086dac4fe7a0be013d61a5008b880db65cd9a09f42730c52","source_id":"us-ky","stale":false,"prev":"us-ky/krs-455.170","next":"us-ky/krs-455.190"},"notice":"GroundRules: Original legal text.
