{"data":{"id":"us-ky/krs-456.050","jurisdiction":"us-ky","citation":"KRS 456.050","heading":"Hearing on petition for interpersonal protective order.","body":"(1) Prior to or at a hearing on a petition for an interpersonal protective order:\n(a) The court may obtain the respondent's Kentucky criminal and protective order\nhistory and utilize t hat information to assess what relief and which sanctions\nmay protect against danger to the petitioner or other person for whom\nprotection is being sought, with the information so obtained being provided to\nthe parties in accordance with the Kentucky Rules of Civil Procedure; and\n(b) If the petitioner or respondent is a minor, the court shall inquire whether the\nparties attend school in the same school system to assist the court in imposing\nconditions in the order that have the least disruption in the admin istration of\neducation to the parties while providing appropriate protection to the\npetitioner.\n(2) (a) If the adverse party is not present at the hearing ordered pursuant to KRS\n456.040 and has not been served, a previously issued temporary interpersonal\nprotective order shall remain in place, and the court shall direct the issuance\nof a new summons for a hearing set not more than fourteen (14) days in the\nfuture. If service has not been made on the adverse party before that hearing\nor a subsequent hearing , the temporary interpersonal protective order shall\nremain in place, and the court shall continue the hearing and issue a new\nsummons with a new date and time for the hearing to occur, which shall be\nwithin fourteen (14) days of the originally scheduled d ate for the continued\nhearing. The court shall repeat the process of continuing the hearing and\nreissuing a new summons until the adverse party is served in advance of the\nscheduled hearing. If service has not been made on the respondent at least\nseventy-two (72) hours prior to the scheduled hearing, the court may continue\nthe hearing no more than fourteen (14) days in the future. In issuing the\nsummons, the court shall simultaneously transmit a copy of the summons or\nnotice of its issuance and provisions t o the petitioner. Upon the request of the\npetitioner, the court may excuse the petitioner from future court appearances\nuntil the respondent has been served.\n(b) The provisions of this section permitting the continuance of an interpersonal\nprotective order  shall be limited to six (6) months from the issuance of the\ntemporary interpersonal protective order. If the respondent has not been\nserved within that period, the order shall be rescinded without prejudice. Prior\nto the expiration of the temporary interp ersonal protective order, the court\nshall provide notice to the petitioner stating that, if the petitioner does not file\na new petition, the order shall be rescinded without prejudice.","path":["KRS Chapter 456"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56238","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:59Z","sha256":"7c731da48e081b7dac6066e4c044bd99f6b587c9ff0526a015bcaf39cfe8723b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-456.040","next":"us-ky/krs-456.060"},"notice":"GroundRules: Original legal text.
