{"data":{"id":"us-ky/krs-457.160","jurisdiction":"us-ky","citation":"KRS 457.160","heading":"Judicial relief.","body":"(1) The following persons may petition a District Court to construe a power of attorney\nor review the agent's conduct, and grant appropriate relief:\n(a) The principal or the agent;\n(b) A guardian, conservator, or other fiduciary acting for the principal;\n(c) A person authorized to make health-care decisions for the principal;\n(d) The principal's spouse, parent, or descendant;\n(e) An individual who would qualify as a presumptive heir of the principal;\n(f) A person named as a beneficiary to receive any property, benefit, or\ncontractual right on the principal's death or as a beneficiary of a trust created\nby or for the principal that has a financial interest in the principal's estate;\n(g) A governmental agency having regulatory authority to protect the welfare of\nthe principal;\n(h) The principal's caregiver or another person that demonstrates sufficient\ninterest in the principal's welfare; and\n(i) A person asked to accept the power of attorney.\n(2) Upon motion by the principal, the court shall dismiss a petition fil ed under this\nsection, unless the court finds that the principal lacks capacity to revoke the agent's\nauthority or the power of attorney.","path":["KRS Chapter 457"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48276","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:59Z","sha256":"dd28e3e142fe1660088cfa1703d1837e99b4d00b6b156ef8933dc8961009c2e8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-457.150","next":"us-ky/krs-457.170"},"notice":"GroundRules: Original legal text.
