{"data":{"id":"us-ky/krs-457.190","jurisdiction":"us-ky","citation":"KRS 457.190","heading":"Acceptance of and reliance upon acknowledged power of attorney.","body":"(1) For purposes of this section and KRS 457.200, \"acknowledged\" means purportedly\nverified before a notary public or other individual authorized to take\nacknowledgements.\n(2) A person that in good faith accepts an acknowledged power of attorney without\nactual knowledge that the signature is not genuine may rely upon the presumption\nunder KRS 457.050 that the signature is genuine.\n(3) A person that in good faith accepts an acknowledged power of attorney without\nactual knowledge that the power of attorney is voi d, invalid, or terminated, that the\npurported agent's authority is void, invalid, or terminated, or that the agent is\nexceeding or improperly exercising the agent's authority may rely upon the power of\nattorney as if the power of attorney were genuine, val id, and still in effect, the\nagent's authority were genuine, valid, and still in effect, and the agent had not\nexceeded and had properly exercised the authority.\n(4) A person that is asked to accept an acknowledged power of attorney may request,\nand rely upon, without further investigation:\n(a) An agent's certification under penalty of perjury of any factual matter\nconcerning the principal, agent, or power of attorney;\n(b) An English translation of the power of attorney if the power of attorney\ncontains, in whole or in part, language other than English; and\n(c) An opinion of counsel as to any matter of law concerning the power of\nattorney if the person making the request provides in a writing or other record\nthe reason for the request.\n(5) An English translation or an opinion of counsel requested under this section must be\nprovided at the principal's expense unless the request is made more than seven (7)\nbusiness days after the power of attorney is presented for acceptance.\n(6) For purposes of this section a nd KRS 457.200, a person that conducts activities\nthrough employees is without actual knowledge of a fact relating to a power of\nattorney, a principal, or an agent if the employee conducting the transaction\ninvolving the power of attorney is without actual knowledge of the fact.","path":["KRS Chapter 457"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48279","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:59Z","sha256":"f27147a6c95f221362d5bd5c55229cf2092fc5502c987a8b2867f2b1aafe7c49","source_id":"us-ky","stale":false,"prev":"us-ky/krs-457.180","next":"us-ky/krs-457.200"},"notice":"GroundRules: Original legal text.
