{"data":{"id":"us-ky/krs-457.270","jurisdiction":"us-ky","citation":"KRS 457.270","heading":"Real property.","body":"Unless the power of attorney otherwise provides, language in a power of attorney granting\ngeneral authority with respect to real property authorizes the agent to:\n(1) Demand, buy, lease, receive, accept as a gift or as security for an extension of\ncredit, or otherwise acquire or reject an interest in real property or a right incident to\nreal property;\n(2) Sell; exchange; convey with or without covenants, representations, or warranties;\nquitclaim; release; surrender; retain title for security; encumber; part ition; consent\nto partitioning; subject to an easement or covenant; subdivide; apply for zoning or\nother governmental permits; plat or consent to platting; develop; grant an option\nconcerning; lease; sublease; contribute to an entity in exchange for an int erest in\nthat entity; or otherwise grant or dispose of an interest in real property or a right\nincident to real property;\n(3) Pledge or mortgage an interest in real property or right incident to real property as\nsecurity to borrow money or pay, renew, or e xtend the time of payment of a debt of\nthe principal or a debt guaranteed by the principal;\n(4) Release, assign, satisfy, or enforce by litigation or otherwise a mortgage, deed of\ntrust, conditional sale contract, encumbrance, lien, or other claim to real property\nwhich exists or is asserted;\n(5) Manage or conserve an interest in real property or a right incident to real property\nowned or claimed to be owned by the principal, including:\n(a) Insuring against liability or casualty or other loss;\n(b) Obtaining or regaining possession of or protecting the interest or right by\nlitigation or otherwise;\n(c) Paying, assessing, compromising, or contesting taxes or assessments or\napplying for and receiving refunds in connection with them; and\n(d) Purchasing supplies, hiring assistance or labor, and making repairs or\nalterations to the real property;\n(6) Use, develop, alter, replace, remove, erect, or install structures or other\nimprovements upon real property in or incident to which the principal has, or claims\nto have, an interest or right;\n(7) Participate in a reorganization with respect to real property or an entity that owns an\ninterest in or right incident to real property and receive, and hold, and act with\nrespect to stocks and bonds or other property received in  a plan of reorganization,\nincluding:\n(a) Selling or otherwise disposing of them;\n(b) Exercising or selling an option, right of conversion, or similar right with\nrespect to them; and\n(c) Exercising any voting rights in person or by proxy;\n(8) Change the form of title of an interest in or right incident to real property; and\n(9) Dedicate to public use, with or without consideration, easements or other real\nproperty in which the principal has, or claims to have, an interest.","path":["KRS Chapter 457"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50157","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:59Z","sha256":"d5ae4dfc0b3561989bd91921d8a78eb684782a7655fd793289302c11c3069e46","source_id":"us-ky","stale":false,"prev":"us-ky/krs-457.265","next":"us-ky/krs-457.280"},"notice":"GroundRules: Original legal text.
