{"data":{"id":"us-ky/krs-457.340","jurisdiction":"us-ky","citation":"KRS 457.340","heading":"Estates, trusts, and other beneficial interests.","body":"(1) In this section, \"estate, trust, or other beneficial interest\" means a trust, probate\nestate, guardianship, conservatorship, escrow, or custodianship or a fund from\nwhich the principal is, may become, or claims to be, entitled to a share or payment.\n(2) Unless the power of attorney otherwise provides, language in a power of attorney\ngranting general authority with respect to estates, trusts, and other beneficial\ninterests authorizes the agent to:\n(a) Accept, receive, receipt for, sell, assign, pledge, or ex change a share in or\npayment from an estate, trust, or other beneficial interest;\n(b) Demand or obtain money or another thing of value to which the principal is,\nmay become, or claims to be, entitled by reason of an estate, trust, or other\nbeneficial interest, by litigation or otherwise;\n(c) Exercise for the benefit of the principal a presently exercisable general power\nof appointment held by the principal;\n(d) Initiate, participate in, submit to alternative dispute resolution, settle, oppose,\nor propose or  accept a compromise with respect to litigation to ascertain the\nmeaning, validity, or effect of a deed, will, declaration of trust, or other\ninstrument or transaction affecting the interest of the principal;\n(e) Initiate, participate in, submit to alterna tive dispute resolution, settle, oppose,\nor propose or accept a compromise with respect to litigation to remove,\nsubstitute, or surcharge a fiduciary;\n(f) Conserve, invest, disburse, or use anything received for an authorized\npurpose;\n(g) Transfer an inter est of the principal in real property, stocks and bonds,\naccounts with financial institutions or securities intermediaries, insurance,\nannuities, and other property to the trustee of a revocable trust created by the\nprincipal as settlor; and\n(h) Reject, re nounce, disclaim, release, or consent to a reduction in or\nmodification of a share in or payment from an estate, trust, or other beneficial\ninterest.","path":["KRS Chapter 457"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50164","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:59Z","sha256":"7efa3d35fcd925ac8263bca03491a2b694087d943685e4895e3245420bdfc774","source_id":"us-ky","stale":false,"prev":"us-ky/krs-457.330","next":"us-ky/krs-457.350"},"notice":"GroundRules: Original legal text.
