{"data":{"id":"us-ky/krs-45a.035","jurisdiction":"us-ky","citation":"KRS 45A.035","heading":"Secretary to promulgate administrative regulations.","body":"(1) The secretary of the Finance and Administration Cabinet shall have power and\nauthority over, and may, except as otherwise expressly provided in this code, adopt\nregulations pursuant to KRS Chapter 13A and consistent with this code governing\nthe purchasing,  management, and control of any and all supplies, services, and\nconstruction, and other items required to be purchased by the Commonwealth. The\nsecretary shall consider and decide matters of policy with regard to state\nprocurement. The secretary shall have  the power of review with respect to the\nimplementation of administrative regulations and policy determinations.\n(2) Administrative regulations shall be promulgated governing the following:\n(a) Conditions and procedures for delegations of purchasing authority;\n(b) Prequalification, suspension, debarment, and reinstatement of prospective\nbidders;\n(c) Small purchase procedures;\n(d) Conditions and procedures for the purchase of items for resale;\n(e) Conditions and procedures for the purchase of agricultural pr oducts in\naccordance with KRS 45A.645;\n(f) Conditions and procedures for the use of source selection methods authorized\nby this code, including emergency purchases;\n(g) Opening and rejection of bids or offers, consideration of alternate bids, and\nwaiver of informalities in offers;\n(h) Confidentiality of technical data and trade secrets information submitted by\nactual or prospective bidders or offerors;\n(i) Partial, progressive, and multiple awards;\n(j) Supervision of storerooms and inventories, including determination of\nappropriate stock levels and the management, transfer, sale, or other disposal\nof state-owned property;\n(k) Definitions and classes of contractual services and procedures for acquiring\nthem;\n(l) An appeals process to resolve disputes arising from specifications requiring\nitems deemed to be equivalent or a sole brand as specified in KRS 45A.170;\n(m) Use of reverse auctions as defined in KRS 45A.070; and\n(n) Policies and procedures governin g timely payments, partial payments,\nreimbursement, and resolution for contract payments in violation of KRS\n45.453 and 45A.137.\nThe secretary may promulgate other administrative regulations as deemed advisable\nto carry out the purposes of this code.","path":["KRS Chapter 45A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57849","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:06Z","sha256":"273e7daca9916e92cb16245d7e91bbbc5284292c8bc334167cb5fba617e2d139","source_id":"us-ky","stale":false,"prev":"us-ky/krs-45a.030","next":"us-ky/krs-45a.040"},"notice":"GroundRules: Original legal text.
