{"data":{"id":"us-ky/krs-45a.050","jurisdiction":"us-ky","citation":"KRS 45A.050","heading":"Centralization of procurement -- Exemptions -- Reciprocal preference for","body":"resident bidders.\n(1) Except as provided in KRS 45A.800 to 45A.835 and KRS Chapters 175, 176, 177,\nand 180, all rights, powers, duties, and authority relating to the pro curement of\nsupplies, services, and construction, and the management, control, warehousing,\nsale, and disposal of supplies, services, and construction now vested in or exercised\nby any state agency under the several statutes relating thereto, are hereby\ntransferred to the secretary of the Finance and Administration Cabinet as provided\nin this code, subject to the provisions of subsection (2) of this section.\n(2) Unless otherwise ordered by the secretary of the Finance and Administration\nCabinet, the acquisi tion of the following shall not be required through the Finance\nand Administration Cabinet:\n(a) Works of art for museum and public display;\n(b) Published books, maps, periodicals, and technical pamphlets; and\n(c) Services of visiting speakers, professors, and performing artists.\n(3) The Finance and Administration Cabinet shall include in all state agency price\ncontracts for the purchase of materials or supplies a provision that, as approved by\nthe secretary of the Finance and Administration Cabinet, any pol itical subdivision,\nincluding cities of all classes, counties, school districts, or special districts, may\nparticipate in these contracts to the same extent as the Commonwealth. Any\npolitical subdivision may purchase materials and supplies in accordance wi th a\ncontract for supplies and materials entered into by the Finance and Administration\nCabinet for the Commonwealth, including those contracts negotiated by the cabinet\nwith vendors who maintain a General Services Administration price agreement as\nprovided in KRS 45A.045(9). Political subdivisions of the Commonwealth must\ncomply with other provisions of the Kentucky Revised Statutes which require\npurchase by competitive bidding, before participating in the contract, unless the\nstate contract has been let b y competitive bidding, or the contract was negotiated as\nprovided in KRS 45A.045(9).\n(4) The Finance and Administration Cabinet shall inform the Department for Local\nGovernment, which shall then inform the appropriate purchasing agent of each\npolitical subdivision interested in participating under this section, of all state agency\ncontracts in effect between the Commonwealth and vendors.\n(5) The secretary of the Finance and Administration Cabinet shall promulgate\nadministrative regulations necessary for the  implementation of this section and\nnecessary to provide that the Commonwealth be reimbursed for any additional\nexpenses incurred by the Commonwealth in allowing political subdivisions to\nparticipate in contracts with vendors.\n(6) The Finance and Administr ation Cabinet shall comply with all provisions relating\nto the methods of purchasing in the Kentucky Revised Statutes. This section is not\nintended to repeal or otherwise affect any provision of the Kentucky Revised\nStatutes regarding purchasing methods of the Finance and Administration Cabinet.\n(7) Notwithstanding any other statute to the contrary, all public agencies as defined in\nKRS 45A.490 shall comply with the provisions for reciprocal preference for\nresident bidders in KRS 45A.490 to 45A.494.","path":["KRS Chapter 45A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57791","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:06Z","sha256":"13e375fc5258f0a48dff5057a55c554e24e9985e29f23c3640b0e9f6fa5d9f6f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-45a.047","next":"us-ky/krs-45a.055"},"notice":"GroundRules: Original legal text.
