{"data":{"id":"us-ky/krs-45a.096","jurisdiction":"us-ky","citation":"KRS 45A.096","heading":"Definitions for KRS 45A.096 and 45A.097.","body":"As used in this section and KRS 45A.097:\n(1) \"Business\" has the same meaning as in KRS 11A.010;\n(2) \"Commemoration\" means an object, such as a plaque or a sign, honoring a living\nperson or an event, but does not include naming rights;\n(3) \"Does business wi th\" or \"doing business with\" has the same meaning as in KRS\n11A.010;\n(4) \"Donation\" means a monetary or in-kind contribution given to a governmental body\nto further the governmental body's mission with no tangible or intangible benefit to\nthe donor. Name r ecognition in promotional materials or on a commemoration or\nmemorial shall not constitute a tangible or intangible benefit to a donor;\n(5) \"Gift\" means a payment, loan, subscription, advance, deposit of money, service, or\nanything of monetary value given to a governmental body to further a governmental\nbody's mission, where only the governmental body receives the tangible or\nintangible benefit, and no personal benefits accrue to any individual;\n(6) \"Memorial\" means an object, such as a plaque or a sign, honoring a deceased person\nor an event, but does not include naming rights;\n(7) \"Naming rights\" means a form of advertising sponsorship contracted by one (1) of\nthe methods in KRS 45A.075(1) or (2) or 45A.077, where a business or other entity\npurchases the r ight to name a building, structure, or any other physical property\nowned or operated by the Commonwealth for a defined period of time, for\nconsideration. No naming rights shall be granted to alter the names of state parks,\ncemeteries, historical memorials, battlefields, state institutions of higher education,\nhistorical landmarks, the Capitol, the Capitol Annex, lakes, or rivers;\n(8) \"Person\" means an individual or any legal entity through which business is\nconducted for profit;\n(9) \"Prohibited source\" means any person, company, or organization that:\n(a) Has a current contractual relationship with a governmental body;\n(b) Conducts operations that are regulated by a governmental body;\n(c) May be lobbying or attempting to influence matters of that governmental\nbody;\n(d) That has any interests that might be affected by the performance or\nnonperformance of official duties of the governmental body or the\ngovernmental body's employees; or\n(e) Is a person, company, or organization currently bidding on or proposing a\ncontractual project with the governmental body under one (1) of the methods\nestablished in KRS 45A.075 or 45A.077;\n(10) \"Public benefit\" means a benefit accrued to a governmental bod y of the\nCommonwealth to further the mission of or improve the governmental body or its\ninfrastructure; and\n(11) \"Sponsorship\" means an agreement for the receipt of cash or noncash value by a\ngovernmental body from a business or other entity in exchange fo r advertising or\nsimilar commercial considerations, including event sponsorships.","path":["KRS Chapter 45A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=47024","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:06Z","sha256":"60e10a1b8499e0fb75626ec8cfee3cf9ed8405eb6c0f77a391b197794f85c384","source_id":"us-ky","stale":false,"prev":"us-ky/krs-45a.095","next":"us-ky/krs-45a.097"},"notice":"GroundRules: Original legal text.
