{"data":{"id":"us-ky/krs-45a.100","jurisdiction":"us-ky","citation":"KRS 45A.100","heading":"Small purchases by state governmental bodies.","body":"(1) Procurements may be made in accordance with small purchase administrative\nregulations promulgated by the secretary of the Finance and Administration\nCabinet, pursuant to KRS Chapter 13A, as follows:\n(a) Up to ten thousand dollars ($10,000) per project for construction and one\nthousand dollars ($1,000) for purchases by any state governmental body,\nexcept for those state administrative bodies specified in paragraph (b) of this\nsubsection; and\n(b) Up to one hundred thousand dollars ($100,000) per project for c onstruction or\npurchases by the Finance and Administration Cabinet, state institutions of\nhigher education, and the legislative branch of government.\n(2) Procurement requirements shall not be artificially divided so as to constitute a small\npurchase under this section. Reverse auctions may be used for small purchase\nprocurements. At least every two (2) years, the secretary shall review the prevailing\ncosts of labor and materials and may make recommendations to the next regular\nsession of the General Assembl y for the revision of the then current maximum\nsmall purchase amount as justified by intervening changes in the cost of labor and\nmaterials.\n(3) The secretary of the Finance and Administration Cabinet may grant to any state\nagency with a justifiable need a  delegation of small purchasing authority which\nexceeds the agency's small purchase limit provided in subsection (1) of this section.\nDelegations of small purchasing authority shall be granted or revoked by the\nsecretary of the Finance and Administration C abinet, in accordance with\nadministrative regulations promulgated by the cabinet pursuant to KRS Chapter\n13A. These administrative regulations shall establish, at a minimum, the criteria for\ngranting and revoking delegations of small purchasing authority, including the\nrequesting agency's past compliance with purchasing regulations, the level of\ntraining of the agency's purchasing staff, and the extent to which the agency utilizes\nthe Kentucky Automated Purchasing System. The administrative regulations may\npermit the secretary of the Finance and Administration Cabinet to delegate small\npurchase procurements up to the maximum amount specified in subsection (1)(b) of\nthis section.","path":["KRS Chapter 45A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54630","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:06Z","sha256":"1331b01118b595767350a3309ecfa643e70d724e02b98e68f395a962cf53c2ca","source_id":"us-ky","stale":false,"prev":"us-ky/krs-45a.097","next":"us-ky/krs-45a.105"},"notice":"GroundRules: Original legal text.
