{"data":{"id":"us-ky/krs-45a.110","jurisdiction":"us-ky","citation":"KRS 45A.110","heading":"Responsibility of bidders and offerors -- Determination -- Right of","body":"nondisclosure.\n(1) A written determination of responsibility of a bidder or offeror shall be made and it\nshall be made in accordance with administrative regulations promulgated by the\nsecretary of the Finance and Administration Cabinet. A reasonable inquiry to\ndetermine the responsibility of a bidder or offeror may be conducted. The failure of\na bidder or offeror to promptly supply information in connection with such an\ninquiry may be grounds for a determination of nonresponsibility with respect to\nsuch a bidder or offeror.\n(2) A written determination of responsibility of a bidder or offeror shall not be made\nuntil the bidder or offeror provides the secretary of the Finance and Administ ration\nCabinet with his sworn statement made under penalty of perjury that he has not\nknowingly violated any provision of the campaign finance laws of the\nCommonwealth and that the award of a contract to a bidder or offeror will not\nviolate any provision o f the campaign finance laws of the Commonwealth.\n\"Knowingly\" means, with respect to conduct or to a circumstance described by a\nstatute defining an offense, that a person is aware or should have been aware that\nhis conduct is of that nature or that the circumstance exists.\n(3) Except as otherwise provided by law, information furnished by a bidder or offeror\npursuant to this section may not be disclosed outside of the Division of State\nPurchasing or the purchasing agency administering the contract without pr ior\nwritten consent of the bidder or offeror.","path":["KRS Chapter 45A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=22348","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:06Z","sha256":"2d64a0d06c125fafae6c8faed0257d8475194f81c30a4f3da4d2499ed33faf8b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-45a.105","next":"us-ky/krs-45a.115"},"notice":"GroundRules: Original legal text.
