{"data":{"id":"us-ky/krs-45a.115","jurisdiction":"us-ky","citation":"KRS 45A.115","heading":"Prequalification of suppliers.","body":"The secretary of the Finance and Administration Cabinet may provide for prequalification\nof suppliers as responsible prospective contractors for particular types of supplies,\nservices, and construction. The secretary of the Finance and Administration Cabin et shall\nnot prequalify a supplier as a responsible prospective contractor until the supplier\nprovides the secretary with his sworn statement made under penalty of perjury that he has\nnot knowingly violated any provision of the campaign finance laws of the\nCommonwealth and that the award of a contract to the supplier will not violate any\nprovision of the campaign finance laws of the Commonwealth. \"Knowingly\" means, with\nrespect to conduct or to a circumstance described by a statute defining an offense, that  a\nperson is aware or should have been aware that his conduct is of that nature or that the\ncircumstance exists. Solicitation lists of potential contractors of such supplies, services,\nand construction shall include but shall not be limited to such prequal ified suppliers.\nPrequalification shall not foreclose a written determination:\n(1) Between the time of the bid opening or receipt of offers and the making of an\naward, that a prequalified supplier is not responsible; or\n(2) That a supplier who is not prequalified at the time of bid opening or receipt of offers\nis responsible.","path":["KRS Chapter 45A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=22349","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:06Z","sha256":"3851819ec989564f66ac5b90752f67f490bf139d45e9112d21a61b7ec1fea251","source_id":"us-ky","stale":false,"prev":"us-ky/krs-45a.110","next":"us-ky/krs-45a.120"},"notice":"GroundRules: Original legal text.
