{"data":{"id":"us-ky/krs-45a.130","jurisdiction":"us-ky","citation":"KRS 45A.130","heading":"Cost reimbursement contracts.","body":"(1) No contract providing for the reimbursement of the contractor's cost plus a fixed\nfee, hereinafter referred to as a cost reimbursement contract, may be made under\nKRS 45A.085, 45A.090 or 45A.095, unless it is determined in writing by the\nsecretary of the F inance and Administration Cabinet that such contract is likely to\nbe less costly to the Commonwealth than any other type of contract, or that it is\nimpracticable to obtain supplies or services of the kind or quality required except\nunder such a contract.\n(2) Each contractor under a cost reimbursement type contract shall give notice, as\nprovided for in the contract, before entering into:\n(a) A cost reimbursement type subcontract; or\n(b) Any other type of subcontract involving more than ten thousand dollars\n($10,000), or ten percent (10%) of the estimated cost of the prime contract.\n(3) All cost reimbursement type contracts shall contain a provision that only costs\nrecognized as allowable, in accordance with cost principles set forth in regulations\nissued pursuant to KRS 45A.215, will be reimbursable.","path":["KRS Chapter 45A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=22352","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:06Z","sha256":"c9d3d6234c7b6adfc91593f5d5985b346b83fb23a9178e982c3abbfd1db965de","source_id":"us-ky","stale":false,"prev":"us-ky/krs-45a.125","next":"us-ky/krs-45a.135"},"notice":"GroundRules: Original legal text.
