{"data":{"id":"us-ky/krs-45a.180","jurisdiction":"us-ky","citation":"KRS 45A.180","heading":"Selection of method of construction contracting management.","body":"(1) The secretary of the Finance and Administration Cabinet shall promulgate\nadministrative regulations by October 15, 2003, providing for as many alternative\nmethods of management of construction contracting as he or she may determine to\nbe feasible; setting forth criteria to be used in determining which method of\nmanagement of construction is to be used for a particular project; establishing a\nmodel process parallel to the selection committee procedures established in\n45A.810 for the procurement of alternativ e project services of \"construction\nmanagement-at-risk\" and \"design -build,\" and for a \"construction manager -general\ncontractor\" and a \"construction manager -agency;\" and providing that the chief\npurchasing officer shall execute and include in the contract f ile a written statement\nsetting forth the facts recommending that a particular method of management of\nconstruction contracting be used. The administrative regulations shall include the\nestablishment of:\n(a) The relative weighing between qualifications and  price, including the\nreciprocal preference for resident bidders required under KRS 45A.494; and\n(b) The level of stipend, if any, available for the various types of projects.\n(2) When a request for proposal for a project utilizing an alternative project d elivery\nmethod is issued, the contracting body shall transmit a copy of the request for\nproposal to the Capital Projects and Bond Oversight Committee staff.\n(3) Upon issuance of the contract for a project utilizing an alternative project delivery\nmethod, the contracting body shall submit the contract to the Government Contract\nReview Committee for review in accordance with KRS 45A.690 to 45A.725. The\ncontracting body shall insure the contract clearly identifies to the committee that an\nalternative project d elivery method is being utilized. Upon disapproval of or\nobjection to the contract by the committee, the contracting body shall determine\nwhether the contract shall be revised to comply with the objections of the\ncommittee, be canceled, or remain in effect . Subsequent contract amendments\nrelating to change orders shall not be required to be submitted to the Government\nContract Review Committee.\n(4) A request for proposal for a project utilizing an alternative project delivery method\nunder this section shall  specifically state the evaluation factors and the relative\nweight of each to be used in the scoring of awards.\n(5) Any governing body of a postsecondary institution that manages its capital\nconstruction program under KRS 164A.580 shall adhere to the regul ations\npromulgated under this section when utilizing an alternative project delivery\nmethod for capital projects, and shall report to legislative committees as specified in\nthis section.\n(6) Any corporation as described by KRS 45.750(2)(c) or as created un der the\nKentucky Revised Statutes as a governmental agency and instrumentality of the\nCommonwealth that manages its capital construction program shall adhere to the\nregulations promulgated under this section when utilizing an alternative project\ndelivery method for capital projects, and shall report to legislative committees as\nspecified in this section.","path":["KRS Chapter 45A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44585","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:06Z","sha256":"0d219aa7bf1debea5b0285fa91a7c66dd2bcb5e83ed18b9dd3333ac765b4384b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-45a.175","next":"us-ky/krs-45a.181"},"notice":"GroundRules: Original legal text.
