{"data":{"id":"us-ky/krs-45a.182","jurisdiction":"us-ky","citation":"KRS 45A.182","heading":"Selection committee procedures to apply when capital project is to be","body":"constructed utilizing the design -build method -- Cancellation or rejection of\nrequests or proposals.\n(1) When a capital project is to be constructed utilizing the design -build metho d in\naccordance with KRS 45A.180, a process parallel to the selection committee\nprocedures established in KRS 45A.810 shall apply when procuring a design -build\nteam and shall incorporate the following:\n(a) The evaluation process may include a multiple phas ed proposal that is based\non qualifications, experience, technical requirements, guaranteed maximum\nprice, and other criteria as set forth in the request for proposal. The guaranteed\nmaximum price component shall be submitted by the offeror independently o f\nother documents and shall be held by the executive director of the Office of\nFacility Development and Efficiency.\n(b) Each evaluator shall independently score each phase and indicate a total score\nfor all evaluation factors as set forth in the request for proposal.\n(c) Final phase proposals from the offerors on the short list shall be evaluated and\nscored by the evaluation committee members who shall not have knowledge\nof the guaranteed maximum price component. Each evaluator shall\nindependently score the  final phase proposals and indicate a total score. A\ntotal average score shall be calculated for each offeror. Then each offeror's\nrespective score for the guaranteed maximum price and any reciprocal\npreference for resident bidders required under KRS 45A.4 94 shall be added.\nThe offeror with the highest point total in the final phase shall receive the\ncontract award unless the guaranteed maximum price proposal is in excess of\nthe authorized budget. If two (2) or more of the offerors achieve the same\nhighest point total at the end of the final phase scoring, the purchasing officer\nshall request best-and-final proposals from each offeror.\n(d) If the guaranteed maximum price of the offeror with the highest point total in\nthe final phase is greater than the amoun t of funds identified in the request for\nproposal, then competitive negotiations may be conducted with the offerors\nunder the following restrictions:\n1. If discussion pertaining to the revision of the specifications or quantities\nare held, the offerors sh all be afforded an opportunity to take part in\nsuch discussions.\n2. Written revisions of the specifications shall be made available to each of\nthe offerors and shall provide for an expeditious response.\n3. Information derived from revised maximum guarant eed price proposals\nshall not be disclosed to competing offerors.\n(2) A request for proposal or other solicitation may be canceled, or all proposals may be\nrejected, if it is determined in writing that such action is taken in the best interest of\nthe Commonwealth and approved by the purchasing officer.","path":["KRS Chapter 45A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=22364","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:06Z","sha256":"dcca853c73f3acc0103643b9b9fd244b561c6bf291ad244600fb74640274fdea","source_id":"us-ky","stale":false,"prev":"us-ky/krs-45a.181","next":"us-ky/krs-45a.183"},"notice":"GroundRules: Original legal text.
