{"data":{"id":"us-ky/krs-45a.200","jurisdiction":"us-ky","citation":"KRS 45A.200","heading":"Contract adjustment clauses -- Termination clause.","body":"(1) For all construction contracts expected to exceed fifty thousand dollars ($50,000) in\nprice, the secretary of the Finance and Administration Cabinet shall specify clauses\nproviding for adjustments to contract terms and conditions where there has been:\n(a) A unilaterally ordered change by the Commonwealth; or\n(b) A site condition differing from that indicated in the contract except for\nturnkey contracts or negotiated contracts when appropriate written findings of\nfact have been made; or\n(c) Variation in the estimated quantities in a contract providing for estimated\nquantities; or\n(d) A unilateral suspension of work by the Commonwealth.\n(2) In addition, there shall also be specified for inclusion in all construction contracts\nexpected to exceed fifty thousand dollars ($50,000) in price a clause providing that\na contract may be terminated for the convenience of the Commonwealth or for\ndefault, and further providing for liquidated damages when appropriate and as\nspecified in the contract schedule, with excuses fo r nonperformance specifically\nprovided for therein.\n(3) The above specified clauses and conditions required for inclusion in all construction\ncontracts expected to exceed fifty thousand dollars ($50,000) in price shall be\navailable for optional use in other construction contracts.","path":["KRS Chapter 45A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=22371","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:06Z","sha256":"16269dea5d1ac3bbc1103f4e7e93403bbd19ca3ce0c430d6ef0b1ac510580b1d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-45a.195","next":"us-ky/krs-45a.205"},"notice":"GroundRules: Original legal text.
