{"data":{"id":"us-ky/krs-45a.300","jurisdiction":"us-ky","citation":"KRS 45A.300","heading":"Cooperative purchasing.","body":"(1) Any public purchasing unit may either participate in, sponsor, conduct, or\nadminister a cooperative purchasing agreement for the acquisition of any supplies,\nservices, or construction with any other public purchasing unit or foreign\npurchasing activity, in  accordance with an agreement entered into between the\nparticipants. This cooperative purchasing may include but is not limited to joint\ncontracts between public purchasing units and access by local public purchasing\nunits to open-ended state public purchasing unit contracts.\n(2) Nothing in this code shall limit any public purchasing unit from selling to, acquiring\nfrom, or using any property belonging to another public purchasing unit or foreign\npurchasing activity independent of the requirements of KRS 45A.070 to 45A.180.\n(3) Nothing in this code shall limit or restrict any public purchasing unit from entering\ninto an agreement, independent of the requirements of KRS 45A.045(6) and KRS\n45A.070 to 45A.165, with any other public purchasing unit or foreign pu rchasing\nactivity for the cooperative use of supplies or services.\n(4) Any public purchasing unit may enter into an agreement for the joint or common\nuse of warehousing facilities or the lease or common use of capital equipment or\nfacilities with any other  public purchasing unit or a foreign purchasing activity\nsubject to the terms as may be agreed upon between the parties.\n(5) Nothing in this code shall limit or restrict the ability of local school districts to\nacquire supplies outside of the public purcha sing agreements when the supplies and\nequipment meeting the same specifications as the contract items are available at a\nlower price elsewhere and the purchase does not exceed two thousand five hundred\ndollars ($2,500).\n(6) Nothing in this code shall limit  any public purchasing unit from receiving notice of\nor accepting a price reduction on supplies or equipment when the supplies or\nequipment are being offered by the vendor with whom a price agreement has been\nmade; the supplies or equipment are being offer ed in accordance with all terms and\nconditions that are specified in the price agreement, except those relating to price;\nand the price reduction is offered to all of the participants in the price agreement.\nPublic purchasing units may accept special price  reductions under this subsection\neven if the reduced price requires the purchase of a specified quantity of units\ndifferent from the quantity stated in the original price agreement. Price reductions\nunder this subsection shall not be considered to permane ntly alter the price of the\nsupplies or equipment under the price agreement with the Commonwealth, except\nwhere the price reductions are to be made permanent under the express terms of the\nprice agreement and where the purchasing agency which solicited the  price\nagreement determines that the enforcement of those terms serves the best interest of\nthe Commonwealth.\n(7) The Finance and Administration Cabinet shall not exclude the Department of Fish\nand Wildlife Resources from, or interfere with the department's participation in, any\ncontracts available to multiple state agencies for the procurement of goods or\nservices, including but not limited to interfering with the department's electronic\naccess to the statewide accounting system in any way.","path":["KRS Chapter 45A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57792","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:07Z","sha256":"98e0096bad73806883436c36cde55d830fb39b20286b7d7f983ed5c6045d51c4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-45a.295","next":"us-ky/krs-45a.305"},"notice":"GroundRules: Original legal text.
