{"data":{"id":"us-ky/krs-45a.343","jurisdiction":"us-ky","citation":"KRS 45A.343","heading":"Local public agency may adopt provisions of KRS 45A.345 to 45A.460 --","body":"Effect of adoption -- Contracts required to mandate revealing of violations of\nand compliance with specified KRS chapters -- Effect of nondisclosure or\nnoncompliance.\n(1) Any local public agency may adopt the provisions of KRS 45A.345 to 45A.460. No\nother statutes governing purchasing shall apply to a local public agency upon\nadoption of these provisions.\n(2) After July 15, 1994, any contract entered into by a local public agency, wh ether\nunder KRS 45A.345 to 45A.460 or any other authority, shall require the contractor\nand all subcontractors performing work under the contract to:\n(a) Reveal any final determination of a violation by the contractor or\nsubcontractor within the previous f ive (5) year period pursuant to KRS\nChapters 136, 139, 141, 337, 338, 341, and 342 that apply to the contractor or\nsubcontractor; and\n(b) Be in continuous compliance with the provisions of KRS Chapters 136, 139,\n141, 337, 338, 341, and 342 that apply to th e contractor or subcontractor for\nthe duration of the contract.\n(3) A contractor's failure to reveal a final determination of a violation by the contractor\nof KRS Chapters 136, 139, 141, 337, 338, 341, and 342 or to comply with these\nstatutes for the durat ion of the contract shall be grounds for the local public\nagency's:\n(a) Cancellation of the contract; and\n(b) Disqualification of the contractor from eligibility for future contracts awarded\nby the local public agency for a period of two (2) years.\n(4) A s ubcontractor's failure to reveal a final determination of a violation by the\nsubcontractor of KRS Chapters 136, 139, 141, 337, 338, 341, and 342 or to comply\nwith these statutes for the duration of the contract shall be grounds for the local\npublic agency' s disqualification of the subcontractor from eligibility for future\ncontracts for a period of two (2) years.","path":["KRS Chapter 45A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=22399","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:07Z","sha256":"7237c350088d1429db73c45591f8e6dc32925d453d3405fc856d47d27c00bb8b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-45a.340","next":"us-ky/krs-45a.345"},"notice":"GroundRules: Original legal text.
