{"data":{"id":"us-ky/krs-45a.380","jurisdiction":"us-ky","citation":"KRS 45A.380","heading":"Noncompetitive negotiation.","body":"A local public agency may contract or purchase through noncompetitive negotiation only\nwhen a written determination is made that competition is not feasible and it is further\ndetermined in writing by a designee of the local public agency that:\n(1) An emerg ency exists which will cause public harm as a result of the delay in\ncompetitive procedures;\n(2) There is a single source within a reasonable geographical area of the product or\nservice to be procured;\n(3) The contract is for the services of a licensed pro fessional, such as attorney,\nphysician, psychiatrist, psychologist, certified public accountant, registered nurse,\nor educational specialist; a technician such as a plumber, electrician, carpenter, or\nmechanic; or an artist such as a sculptor, aesthetic pa inter, or musician, provided,\nhowever, that this provision shall not apply to architects or engineers providing\nconstruction management services rather than professional architect or engineer\nservices;\n(4) The contract is for the purchase of perishable foods, such as meat, fish, poultry, egg\nproducts, fresh vegetables, and fresh fruits;\n(5) The contract is for replacement parts where the need cannot be reasonably\nanticipated and stockpiling is not feasible;\n(6) The contract is for proprietary items for resale;\n(7) In school districts the contract relates to an enterprise in which the buying or selling\nby students is a part of the educational experience;\n(8) The contract or purchase is for expenditures made on authorized trips outside of the\nboundaries of the local public agency;\n(9) The contract is for the purchase of supplies which are sold at public auction or by\nreceiving sealed bids;\n(10) The contract is for group life insurance, group health and accident insurance, group\nprofessional liability insurance, worker's compensation insurance, and\nunemployment insurance;\n(11) The contract is for a sale of supplies at reduced prices that will affo rd a purchase at\nsavings to the local public agency;\n(12) The contract is with a private real estate developer and contains a requirement:\n(a) That the developer increase the size or otherwise improve the collection\ncapacity of the sanitary sewer or storm water pipe serving the affected private\nreal estate development; and\n(b) That the local public agency pay only the proportional cost of increasing the\nsize, or otherwise improving the collection capacity, of the sanitary sewer or\nstorm water pipe over the original collection capacity; or\n(13) The contract is for the purchase of used vehicles or used equipment and the\npurchase price does not exceed seventy -five percent (75%) of the manufacturer's\nsuggested retail price for the model year for a vehicle or dat e of manufacture for\nequipment for the same or similar vehicles or equipment.","path":["KRS Chapter 45A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57559","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:07Z","sha256":"05338ecf6d80cb06c9b25a13a704a6dde8dd9560510ff0079c3c9c412c0e8a0d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-45a.375","next":"us-ky/krs-45a.385"},"notice":"GroundRules: Original legal text.
