{"data":{"id":"us-ky/krs-45a.415","jurisdiction":"us-ky","citation":"KRS 45A.415","heading":"Specifications -- Items considered equal may be furnished -- Proprietary","body":"products.\n(1) The local public agency shall use specifications which assure the maximum\npracticable competition to meet the agency's needs.\n(2) Local public agencies shall ensure  that every invitation for bids or request for\nproposals provides that an item equal to that named or described in the\nspecifications may be furnished. The specifications may identify a sole brand in\ncases where, in the written opinion of the chief procure ment officer, documented\nunique and valid conditions require compatibility, continuity, or conformity with\nestablished standards. An item shall be considered equal to the item named or\ndescribed if, in the opinion of the owner and the design professional r esponsible for\nthe specifications:\n(a) It is at least equal in quality, durability, strength, design, and other criteria\ndeemed appropriate;\n(b) It will perform at least equally the function imposed by the general design for\nthe public work being contracted for or the material being purchased; and\n(c) It conforms substantially to the detailed requirements for the item in the\nspecifications.\n(3) A specification which describes a product which is proprietary to one (1) company\nmay be used only when no other k ind of specification is reasonably available to\ndescribe requirements.","path":["KRS Chapter 45A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=22417","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:07Z","sha256":"282eaa5e5efedda9679de3107a66eea4e691963e3da58fd5d24a7036aec20525","source_id":"us-ky","stale":false,"prev":"us-ky/krs-45a.410","next":"us-ky/krs-45a.420"},"notice":"GroundRules: Original legal text.
