{"data":{"id":"us-ky/krs-45a.425","jurisdiction":"us-ky","citation":"KRS 45A.425","heading":"Surplus or excess property.","body":"(1) A local public agency may sell or otherwise dispose of any personal property which\nis not needed or has become unsuitable for public use, or which would be suitable,\nconsistent with the public interest, for some other use.\n(2) A written determination as to  need of suitability of any personal property of the\nlocal public agency shall be made; and such determination shall fully describe the\npersonal property; its intended use at the time of acquisition; the reasons why it is in\nthe public interest to dispose of the item; and the method of disposition to be used.\n(3) Surplus or excess personal property as described in this section may be transferred,\nwith or without compensation, to another governmental agency; or it may be sold at\npublic auction or by sealed bids in accordance with KRS 45A.365.\n(4) In the event that a local public agency receives no bids for surplus or excess\npersonal property, either at public auction or by sealed bid, such property may be\ndisposed of, consistent with the public interest, in a ny manner deemed appropriate\nby the local public agency. In such instances, a written description of the property,\nthe method of disposal, and the amount of compensation, if any, shall be made. Any\ncompensation resulting from the disposal of surplus or exc ess personal property\nshall be transferred to the general fund of the local public agency.\n(5) A local board of education may dispose of its surplus technology in accordance with\nKRS 160.335.\n(6) As an alternative procedure to that set out in this section,  a county may dispose of\npersonal property pursuant to KRS 67.0802.\n(7) Notwithstanding subsections (1) to (4) of this section, a city, urban -county\ngovernment, or consolidated local government that has adopted KRS 45A.345 to\n45A.460 may dispose of surplus property using the procedures in KRS 82.083.","path":["KRS Chapter 45A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48744","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:07Z","sha256":"11659d00765148ae496b17be1c1a11cae8d89814de02e69513420da85a1ab8c7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-45a.420","next":"us-ky/krs-45a.430"},"notice":"GroundRules: Original legal text.
