{"data":{"id":"us-ky/krs-45a.455","jurisdiction":"us-ky","citation":"KRS 45A.455","heading":"Conflict of interest -- Gratuities and kickbacks -- Use of confidential","body":"information.\n(1) It shall be a breach of ethical standards for any employee with procurement\nauthority to participate directly in any proceeding or application; request for ruling\nor other determination; claim or controversy; or other particular matter pertaining to\nany contract, or subcontract, and any solicitation or proposal therefor, in which to\nhis knowledge:\n(a) He, or any member of his immediate family has a financial interest therein; or\n(b) A business or organization in which he or any member of his immediate\nfamily has a financial interest as an officer, director, trustee, partner, or\nemployee, is a party; or\n(c) Any other person, business, or organization with whom he or any member of\nhis immediate family is negotiating or has an arrangement concerning\nprospective employment is a party.  Direct or indirect participation shall\ninclude but not be limited to involvement through decision, approval,\ndisapproval, recommendation, preparation of any part of a purchase request,\ninfluencing the content of any specification or purchase standard, rendering of\nadvice, investigation, auditing, or in any other advisory capacity.\n(2) It shall be a breach of ethical standards for any person to offer, give, or agree to give\nany employee or former employee, or for any employee or former employee to\nsolicit, demand, accept, or agree to accept from another person, a gratuity or an\noffer of employment, in connection with any decision, approval, d isapproval,\nrecommendation, preparation of any part of a purchase request, influencing the\ncontent of any specification or purchase standard, rendering of advice, investigation,\nauditing, or in any other advisory capacity in any proceeding or application, request\nfor ruling or other determination, claim or controversy, or other particular matter,\npertaining to any contract or subcontract and any solicitation or proposal therefor.\n(3) It is a breach of ethical standards for any payment, gratuity, or offer of  employment\nto be made by or on behalf of a subcontractor under a contract to the prime\ncontractor or higher tier subcontractor or any person associated therewith, as an\ninducement for the award of a subcontract or order.\n(4) The prohibition against confli cts of interest and gratuities and kickbacks shall be\nconspicuously set forth in every local public agency written contract and solicitation\ntherefor.\n(5) It shall be a breach of ethical standards for any public employee or former employee\nknowingly to use  confidential information for his actual or anticipated personal\ngain, or the actual or anticipated personal gain of any other person.","path":["KRS Chapter 45A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=22425","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:07Z","sha256":"a2f93115a07189670fc33f6dd7116c0194d50e9016282e9e746520fe2db25e69","source_id":"us-ky","stale":false,"prev":"us-ky/krs-45a.450","next":"us-ky/krs-45a.460"},"notice":"GroundRules: Original legal text.
