{"data":{"id":"us-ky/krs-45a.470","jurisdiction":"us-ky","citation":"KRS 45A.470","heading":"Preference to be  given by  governmental  bodies and  political","body":"subdivisions  in  purchasing  commodities  or  services  -- List of\ncommodities  and  services -- Price range -- Negotiation for identical\nproducts and services.\n(1) Notwithstanding any provision of this chapter to the contrary, all governmental\nbodies  and  political subdivisions of this state shall, when  purchasing\ncommodities or services, give first preference to the products made  by the\nDepartment of Corrections, Division of Prison Industries, as required by KRS\n197.210. Second  preference shall be given to any products produced by\nKentucky  Industries for the Blind, Incorporated, or any  other nonprofit\ncorporation that furthers the purposes of KRS  Chapter 163, and agencies of\nindividuals with severe disabilities as described in KRS 45A.465.\n(2) The Finance and Administration Cabinet shall make a list of commodities and\nservices provided by these agencies and  organizations available to all\ngovernmental bodies and political subdivisions. The list shall identify in detail\nthe commodity or service the agency or organization may supply and the price.\n(3) The  Finance and Administration Cabinet shall annually determine the current\nprice range for the commodities and services offered from its experience in\npurchasing these commodities or services on the open market. The prices\nquoted by these agencies or organizations shall not exceed the current price\nrange.\n(4) The Office of Vocational Rehabilitation within the Education and Labor Cabinet\nand  qualified agencies for individuals with severe disabilities shall annually\ncause to be made available to the Finance and Administration Cabinet, lists of\nthe products or services available.\n(5) If two (2) or more of the agencies or qualified nonprofit organizations wish to\nsupply identical commodities or services, the Finance and Administration\nCabinet shall conduct negotiations with the parties to determine which shall be\nawarded the contract. The decision of the Finance and Administration Cabinet\nshall be based upon quality of the commodity or service and the ability of the\nrespective agencies to supply the commodity or service within the requested\ndelivery time.","path":["KRS Chapter 45A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52330","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:07Z","sha256":"02b22578c28030fa0871b5bcdff7396ea7825027ea88f680224b38c065cbd2c5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-45a.465","next":"us-ky/krs-45a.475"},"notice":"GroundRules: Original legal text.
