{"data":{"id":"us-ky/krs-45a.480","jurisdiction":"us-ky","citation":"KRS 45A.480","heading":"Compliance with workers' compensation insurance and unemployment","body":"insurance laws required -- Foreign entity to obtain certificate of authority --\nPenalty.\n(1) (a) No state contract for building, construction, reconstruction, renovation,\ndemolition, o r maintenance, or for any activity related to building,\nconstruction, reconstruction, renovation, demolition, or maintenance shall be\nawarded by any agency, department, or office of the Commonwealth of\nKentucky or any political subdivision of the Commonwea lth of Kentucky to\nany person until that person assures, by affidavit, that all contractors and\nsubcontractors employed, or that will be employed, under the provisions of the\ncontract shall be in compliance with Kentucky requirements for workers'\ncompensation insurance according to KRS Chapter 342 and unemployment\ninsurance according to KRS Chapter 341.\n(b) An agency, department, office, or political subdivision of the Commonwealth\nof Kentucky shall not award a state contract to a person that is a foreign e ntity\nunless that foreign entity, on the records of the Secretary of State, holds a\ncertificate of authority or a statement of foreign qualification.\n(2) Any person who fails to comply with the requirements of subsection (1) of this\nsection during the term  of the state contract, upon such finding by a court of\ncompetent jurisdiction, shall be fined an amount not to exceed four thousand dollars\n($4,000), or an amount equal to the sum of uninsured and unsatisfied claims\nbrought under the provisions of KRS Cha pter 342 and unemployment insurance\nclaims for which no wages were reported as required by KRS Chapter 341,\nwhichever is greater.\n(3) The penalty imposed in subsection (2) of this section shall be enforced by the\ncounty attorney for the county in which the violation occurred.","path":["KRS Chapter 45A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40425","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:07Z","sha256":"5df726a28b76c984fd6604931b1beb84bf785d8b93dd67cc09ded70d750b6627","source_id":"us-ky","stale":false,"prev":"us-ky/krs-45a.475","next":"us-ky/krs-45a.485"},"notice":"GroundRules: Original legal text.
