{"data":{"id":"us-ky/krs-45a.550","jurisdiction":"us-ky","citation":"KRS 45A.550","heading":"Definitions for KRS 45A.550 to 45A.554 and KRS 11A.130.","body":"As used in KRS 45A.550 to 45A.554 and KRS 11A.130, unless the context requires\notherwise:\n(1) \"Privatize\" means to contract out in order to procure the services of a private vendor\nto provide a service that is similar to, and in lieu of, a service provided by state\nemployees of the privatizing agency;\n(2) \"Privatization contract\" means an agreement or combination of a series of\nagreements by which a private vendor agrees to prov ide services that are\nsubstantially similar to, and in lieu of, services previously provided, in whole or in\npart, by at least ten (10) permanent, full -time, budgeted employees of the state\nagency. This term includes but is not limited to concession contra cts. This term\ndoes not include personal service contracts as defined in KRS 45A.690, contracts\nentered into pursuant to KRS Chapter 176, 177, 178, 179, 180, or 181, Medicaid\nprovider contracts, architect and engineering contracts entered into pursuant to KRS\n45A.800 to 45A.835, price contracts, construction contracts, or memoranda of\nunderstanding or memoranda of agreements or program administration contracts\nwith the Office of the Attorney General, including contracts for child support\ncollections and enf orcement with contracting officials as authorized by KRS\n15.802; and\n(3) \"Services\" shall not include administration and support functions of government.\n\"Administration and support functions\" shall include, but not be limited to,\nconstruction contracts, b ond counsel and bond underwriting services, architect and\nengineering services, price contracts, personal service contracts, and memoranda of\nunderstanding and memoranda of agreement.","path":["KRS Chapter 45A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54405","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:07Z","sha256":"0cf2fa403a02307f6eea9eb641e4b1f45103d446fff9e57de854631f55d4178b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-45a.540","next":"us-ky/krs-45a.551"},"notice":"GroundRules: Original legal text.
