{"data":{"id":"us-ky/krs-45a.607","jurisdiction":"us-ky","citation":"KRS 45A.607","heading":"Required contract provision restricting contractor from participating","body":"in certain boycott actions -- Exceptions -- Administrative regulations.\n(1) As used in this section:\n(a) \"Boycott\" means  refusing to deal with, terminating business activities\nwith, or otherwise taking any action that is intended to penalize, inflict\neconomic harm on, or limit commercial relations with:\n1. A jurisdiction with which Kentucky can enjoy open trade; or\n2. A  person or entity doing business with a jurisdiction with which\nKentucky can enjoy open trade; but\n\"boycott\" does not mean  an action taken for bona fide business or\neconomic reasons or that is specifically required by federal or state law;\nand\n(b) \"Jurisdiction with which Kentucky can enjoy open trade\" means:\n1. Any World Trade Organization member; and\n2. Any jurisdiction with which the United States has free trade or other\nagreements  aimed at ensuring open and nondiscriminatory trade\nrelations.\n(2) A governmental body shall not enter into a contract under this chapter with a\ncontractor unless the contract includes a representation by the contractor that\nthe contractor is not currently engaged in, and will not for the duration of the\ncontract engage in, the boycott of a person or an entity based in or doing\nbusiness with a jurisdiction with which Kentucky can enjoy open trade. This\nsubsection shall not apply to a:\n(a) Contract with a value of less than one  hundred thousand dollars\n($100,000); or\n(b) Contractor who:\n1. Is an individual; or\n2. Employs five (5) or fewer employees.\n(3) A governmental body may terminate a contract with a contractor for:\n(a) A false representation made under subsection (2) of this section; or\n(b) Engaging in a boycott at the time of entering into the contract or during\nthe duration of the contract.\n(4) A  request for proposal, invitation to bid, or other document  issued by a\ngovernmental body with the intent of soliciting responses for the potential\naward of a contract shall include notice of the requirements under this section.\n(5) The secretary shall promulgate administrative regulations under KRS  Chapter\n13A for the administration of this section.","path":["KRS Chapter 45A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48539","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:07Z","sha256":"2898f91eb7dd3699b030cddb47e23a70bd094db4d965f1351c0d94ebba3021f6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-45a.605","next":"us-ky/krs-45a.610"},"notice":"GroundRules: Original legal text.
