{"data":{"id":"us-ky/krs-45a.750","jurisdiction":"us-ky","citation":"KRS 45A.750","heading":"Negotiation of contract.","body":"(1) Based on the rankings developed in KRS 45A.745(3), the local public agency shall\ncontact the highest -ranked firm and attempt to negotiate a contract for a fair and\nreasonable value that takes the following into account:\n(a) The estimated value of the services needed;\n(b) The scope and complexity of the proposed project;\n(c) The business risk anticipated; and\n(d) The professional nature of the services required.\n(2) If the local public agency is unable to negotiate a satisfactory contract with the\nhighest-ranked firm, negotiations with that firm shall be terminated. The local\npublic agency shall then go through the negotiation process with the next firm in the\nrankings, continuing this procedure until an agreement is reached or the list of\nranked firms is exhausted.\n(3) If negotiations with all of the ranked firms fail to result in a satisfactory contract, the\nlocal public agency shall reevaluate the architectural or engineering services\ninvolved in the proposed project and proceed to comply with KRS 45A.740 a nd\n45A.745 until a contract is successfully negotiated.","path":["KRS Chapter 45A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=22479","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:08Z","sha256":"3c3d11f86000d5c4b03a08dedce3cca78072366b6d36e050357b9e3ffacc536a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-45a.745","next":"us-ky/krs-45a.800"},"notice":"GroundRules: Original legal text.
