{"data":{"id":"us-ky/krs-45a.837","jurisdiction":"us-ky","citation":"KRS 45A.837","heading":"Price contracts for architectural, engineering, and engineering -related","body":"services -- Review procedure required.\n(1) Notwithstanding the provisions of KRS 45A.800 to 45A.835, the Finance and\nAdministration Cabinet, the Department of Fish and Wildli fe Resources, and the\nTransportation Cabinet may enter into price contracts for architectural, engineering,\nand engineering -related services. If the agencies choose to enter into a price\ncontract, subsection (2) of this section shall apply.\n(2) Price contr acts shall be awarded to firms qualified by the Finance and\nAdministration Cabinet, Department of Facilities Management or by the\nTransportation Cabinet, Department of Highways. The Finance and Administration\nCabinet selection committee established by KRS 45A.810 shall meet at least\nquarterly during each fiscal year to review and make recommendations to the\ncommissioner of the Department for Facilities Management for qualification of\ninterested firms. The Transportation Cabinet selection committee establish ed by\nKRS 45A.810 shall meet at least quarterly during each fiscal year to review and\nmake recommendations to the commissioner of the Department of Highways for\nqualification of interested firms.\n(a) The respective committees shall evaluate those firms sub mitting statements of\ninterest in obtaining a price contract. The submitting firms shall be reviewed\naccording to the following criteria:\n1. Qualifications;\n2. Ability of professional personnel; and\n3. Past record and experience.\n(b) Firms qualified by the  commissioner of the Department for Facilities\nManagement or by the commissioner of the Department of Highways shall be\nawarded price contracts by the respective departments for the type of work for\nwhich they have been qualified.\n(c) The commissioner of t he Department for Facilities Management, the\ncommissioner of the Department of Fish and Wildlife Resources, or the\ncommissioner of the Department of Highways may select firms to perform\nwork under price contract for small projects for which the architectur al,\nengineering, or engineering -related fees do not exceed one hundred fifty\nthousand dollars ($150,000). However, no firm that has received more than\nthree hundred thousand dollars ($300,000) in price contract fees in any one\n(1) fiscal year in the contra ct discipline being awarded shall be selected to\nwork under a price contract unless the secretary of the Finance and\nAdministration Cabinet, the secretary of the Transportation Cabinet, or the\ncommissioner of the Department of Fish and Wildlife Resources m akes a\nwritten determination that the selection is in the best interest of the\nCommonwealth and the determination is confirmed by the appropriate\ncabinet's or department's selection committee established by KRS 45A.810.\n(3) Notwithstanding any provision of the Kentucky Revised Statutes, no price contract\nshall be awarded under the provisions of this section before completion of the\nreview procedure provided for in KRS 45A.695 and 45A.705.","path":["KRS Chapter 45A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53579","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:08Z","sha256":"6c57b909689b806b003db039f0f835226171c8aecf40beea68c74ebcdf777a98","source_id":"us-ky","stale":false,"prev":"us-ky/krs-45a.836","next":"us-ky/krs-45a.838"},"notice":"GroundRules: Original legal text.
