{"data":{"id":"us-ky/krs-45a.838","jurisdiction":"us-ky","citation":"KRS 45A.838","heading":"Establishment and operation of pool of firms to provide professional","body":"contract services -- Administrative regulations to be promulgated by\nTransportation Cabinet and Department of Fish and Wildlife Resources.\n(1) If choosing to operate under this section, the Transportation Cabinet and the\nDepartment of Fish and Wildlife Resources shall, by administrative regulations\npromulgated under KRS Chapter 13A, designate each type of project for which a\npool of firms is to be established and from which the f irm to provide the needed\narchitectural, engineering, or engineering-related contract services is to be selected.\nThe project types designated by these administrative regulations shall be limited to\nthose projects for which the professional services to be rendered for each individual\ncontract are substantially similar and to those project types for which architectural,\nengineering, or engineering -related fees are expected to be at least fifty thousand\ndollars ($50,000).\n(2) The Transportation Cabinet and th e Department of Fish and Wildlife Resources\nselection committees established under KRS 45A.810 shall annually select the\nengineering or engineering -related services firms for each pool in accordance with\nthe standards for application and selection establis hed by administrative regulation\nunder subsection (4) of this section.\n(3) Once selected for a particular pool, a firm providing architectural, engineering, or\nengineering-related services shall remain in the pool for two (2) years unless\ndisqualified under subsection (6) of this section. Upon the expiration of the two (2)\nyear period, a firm may reapply for selection.\n(4) The procedures and criteria for qualifying and selecting the firms to be placed in\neach annual pool shall be set forth in administrative  regulations promulgated by the\nTransportation Cabinet or the Department of Fish and Wildlife Resources. The\nadministrative regulations shall provide for adequate notice to firms of the\nestablishment of the individual pools, an application procedure for a firm interested\nin the pool for a particular type of project, the deadline for submission of the\napplication, and the criteria to be used for the establishment of each pool.\n(5) The procedures for determining which firm is to be selected from the pool to\nprovide services for a particular project shall be set forth in administrative\nregulations promulgated by the Transportation Cabinet or the Department of Fish\nand Wildlife Resources.\n(6) The secretary of the Transportation Cabinet or the commissioner of the  Department\nof Fish and Wildlife Resources may remove a firm from a pool for good cause. Any\nfirm that has been removed from a pool may, within thirty (30) days after the\nremoval, petition the secretary for reinstatement. Within sixty (60) days following\nthe secretary's receipt of a petition, the selection committee shall meet to consider\nthe request for reinstatement. If the selection committee recommends that the firm\nbe reinstated to the pool and the secretary accepts the recommendation, the affected\nfirm shall be reinstated.\n(7) After one (1) year of disqualification, a firm that has been removed from a pool\nunder subsection (6) of this section may reapply to be qualified.\n(8) Nothing in this section shall be construed to require use of any pool for a pa rticular\nproject if the responsible cabinet or department has determined that the project does\nnot meet the criteria established for pool projects.","path":["KRS Chapter 45A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53580","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:08Z","sha256":"186d706925f7d8acafc2799934402cb41356efab3f9843418b87ffaacda5a22e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-45a.837","next":"us-ky/krs-45a.840"},"notice":"GroundRules: Original legal text.
