{"data":{"id":"us-ky/krs-45a.840","jurisdiction":"us-ky","citation":"KRS 45A.840","heading":"Definitions for KRS 45A.840 to 45A.879.","body":"As used in KRS 45A.840 to 45A.879, unless the context requires otherwise:\n(1) \"Bond counsel\" means an attorney who provides legal counsel to a bond issuing\nagency with regard to bond issuance and provides an unqualified legal opinion to\nthe agency with respect to validity and tax treatment;\n(2) \"Bond issuance\" means the formulation, authorization, and issuance of bonds by a\nbond issuing agency;\n(3) \"Bond issuing agency\" means the State Property and Buildings Commission,\nKentucky Asset/Liability Commission, Turnpike Authority of Kentucky, Kentucky\nHousing Corporation, Kentucky Infrastructure Authority, Kentucky Higher\nEducation Student Loan Corporation, Kentucky River Authority, Kentucky\nAgricultural Finance Corporation, Kentucky Local Correctional Facilities\nConstruction Authority, School Facilities Construction Commission, Murray State\nUniversity, Western Kentucky University, University of Louisville when it declines\nto exercise the authority granted under KRS 164A.585(1) and 164A.605, Northern\nKentucky University, Kentucky State University, University of Kentucky when it\ndeclines to exercise the authority granted under KRS 164A.585(1) and 164A.605,\nMorehead State University, Eastern Kentucky University, and the Kentucky\nCommunity and Technical College System;\n(4) \"Bonds\" means the revenue bonds, notes, or other debt obligations issued by a bond\nissuing agency;\n(5) \"Executive director\" means the executive director of the Office of Financial\nManagement;\n(6) \"Office\" means the Office of Financial Management established by KRS 42.0201;\n(7) \"Underwriter\" means:\n(a) The financial institution which structures and underwrites the bond issuing\nagency's issuance of bonds; or\n(b) The financial advisor or fiscal agent which provides advice or services to the\nbond issuing agency with respect to the structure, timing, terms, or other\nmatters concerning bond issuance;\n(8) \"Underwriter's counsel\" means an attorney who provides legal counsel to an\nunderwriter with respect to its work on behalf of a bond issuing agency.","path":["KRS Chapter 45A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=22494","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:08Z","sha256":"d9b90a8eba0b7111d9f8c63cadcc3b3436736c46482659ee4aeed797a6771912","source_id":"us-ky","stale":false,"prev":"us-ky/krs-45a.838","next":"us-ky/krs-45a.843"},"notice":"GroundRules: Original legal text.
