{"data":{"id":"us-ky/krs-48.027","jurisdiction":"us-ky","citation":"KRS 48.027","heading":"Appropriations not to be used by state official or agency to challenge","body":"constitutionality -- Limited exceptions -- Attorney General sole named\nrespondent in challenge to this section.\n(1) Notwithstanding any statute, administrative regulation, or common  law to the\ncontrary, and except as provided in this subsection, appropriations from the\ngeneral fund, any restricted fund, the road fund, or any federal funds, whether\nfor employee time or any other purpose, shall not be expended by an elected\nstatewide constitutional officer, except the Attorney General, or by any other\nstate official, employee, or agency, other than the Department of Public\nAdvocacy  in a criminal matter, to bring or support a challenge to the\nconstitutionality of any legislative act or resolution of the General Assembly.\nNothing in this section shall limit any officer, official, employee, or agency in the\ndefense of any action brought against him or her by a party with proper\nstanding.\n(2) If the constitutionality of subsection (1) of this section is challenged through\nlitigation, the Attorney General shall be the sole named  respondent for the\nCommonwealth  of Kentucky in such litigation and shall consult with the\nLegislative Research Commission regarding defense of such litigation.","path":["KRS Chapter 48"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52182","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:09Z","sha256":"df83924de32d1d0675b66d4a4636563957cc256f044b6790884e36deb233d2ef","source_id":"us-ky","stale":false,"prev":"us-ky/krs-48.025","next":"us-ky/krs-48.030"},"notice":"GroundRules: Original legal text.
