{"data":{"id":"us-ky/krs-48.140","jurisdiction":"us-ky","citation":"KRS 48.140","heading":"Surplus expenditure plan to be included in each enacted branch budget bill","body":"-- Surplus in excess of two and one-half percent to accrue to surplus account.\n(1) The General Assembly shall include in each enacted branch budget bill a plan for\nthe expenditure of a general fund or road fund surplus.\n(2) If there is a surplus, the Office of State Budget Director shall notify all branches of\ngovernment.\n(3) Except as provided in KRS 48.705, any surplus in the general or road fund in\nexcess of two and one -half percent (2.5%) of the enacted estimates shall not be\nexpended but shall accrue to the surplus account of the general fund or road fund\nfor investment until appropriated by the General Assembly.\n(4) Unless required by the budget reduction provisions in a branch budget bill, no funds\nshall be transferred from one budget unit to another budget unit.\n(5) Surplus funds in any account, unless a statute requires otherwise, shall lapse to the\nsurplus account of the general fund for investment until appropriated by the General\nAssembly.\n(6) Funds in the surplus account of the general fund may be used for current\nexpenditures as authorized by the budget reduction provisions of a branch budget\nbill.","path":["KRS Chapter 48"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=22548","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:09Z","sha256":"4e6602f704f41f233a2680adc83ff92e4602655069d982a0f1bea64ad17f8757","source_id":"us-ky","stale":false,"prev":"us-ky/krs-48.130","next":"us-ky/krs-48.150"},"notice":"GroundRules: Original legal text.
