{"data":{"id":"us-ky/krs-48.630","jurisdiction":"us-ky","citation":"KRS 48.630","heading":"Allotment of unbudgeted appropriation -- Legislative committee review --","body":"Use of unanticipated restricted or federal funds -- Exemptions.\n(1) An unbudgeted appropriation shall not be allotted without prior review and action\nby the Interim Joint Com mittee on Appropriations and Revenue as provided for in\nthis section.\n(2) Except as otherwise provided in this section, any request for allotment of\nunbudgeted appropriations from any fund source shall be made in writing by the\nhead of the budget unit and transmitted simultaneously to the state budget director\nand the Interim Joint Committee on Appropriations and Revenue.\n(3) The state budget director may recommend a proposed revision to a specified\nappropriation in any branch budget bill to the Interim Joi nt Committee on\nAppropriations and Revenue by the seventh day of each month.\n(4) If the Interim Joint Committee on Appropriations and Revenue fails to review and\nact upon the proposed revision by the last day of the month, the proposed revision\nshall be deemed to have been reviewed and favorably acted upon.\n(5) The Interim Joint Committee on Appropriations and Revenue shall review the\nproposed expenditure of the unbudgeted appropriation for conformance with the\npurposes of the proposed appropriation and the  enacted branch budget bill and any\nother relevant statute, by the last day of each month.\n(6) If the Interim Joint Committee on Appropriations and Revenue disapproves of the\nproposed revision of the enacted appropriation, the budget adjustment shall be\ninvalid unless it is:\n(a) Revised to comply with the objections of the committee; or\n(b) The committee is informed, in writing, in detail, within thirty (30) days of the\ncommittee's disapproval, that a determination has been made not to comply\nwith the objections of the committee.\n(7) If an emergency unbudgeted appropriation revision is required due to a declared\nnatural disaster, calamity, or impending deficit in an enacted appropriation as\ncertified by the Governor, the state budget director may effect an e mergency\nrevised appropriation, with the approval of the secretary of the Finance and\nAdministration Cabinet, and with concurrent notification to the Interim Joint\nCommittee on Appropriations and Revenue of the action and its justification.\n(8) If a budget  unit not listed in any enacted branch budget bill receives unanticipated\nrestricted funds or federal funds, the secretary of the Finance and Administration\nCabinet, upon written request from the agency head with appropriate\ndocumentation of the amount, so urce, purpose, necessity, and use of the moneys,\nmay authorize the credit and expenditure of these funds for statutory purposes, upon\nrecommendation of the state budget director and review and action by the Interim\nJoint Committee on Appropriations and Rev enue pursuant to the conditions and\nprocedures prescribed by this section. The secretary shall cause to be established a\nseparate discrete restricted funds or federal funds account, as appropriate, for the\nreceipt and disbursement of these funds and shall establish the maximum sum\nwhich may be credited and expended from the authorized account.\n(9) Institutions of higher education shall be exempt from all conditions and procedures\nin this section with respect to the authority of the state budget director and the\nsecretary of the Finance and Administration Cabinet to review and approve\nunbudgeted restricted funds or federal funds or revisions to appropriations in excess\nof any enacted branch budget bill; however, in the event of a revision, an institution\nof higher education shall report unbudgeted restricted funds and federal funds to the\nstate budget  director and the Interim Joint Committee on Appropriations and\nRevenue.\n(10) Unbudgeted appropriations for expenditure in the judicial branch budget and the\nlegislative branch budget shall be exempt from all conditions and procedures in this\nsection, exce pt that each branch head, or its designee, shall report unbudgeted\nrestricted funds and federal funds to the Interim Joint Committee on Appropriations\nand Revenue and transmit an informational copy to the state budget director.\n(11) The Legislative Research Commission shall maintain records of the findings of the\nInterim Joint Committee on Appropriations and Revenue and the determinations\nand reports of actions by the state budget director and transmit these records to the\nGeneral Assembly when next convened.","path":["KRS Chapter 48"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=39794","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:09Z","sha256":"4ea6cc9a9f4ec5e498dab9b7216bfccb5103a4b0c8c2fe22ad3c869f11618153","source_id":"us-ky","stale":false,"prev":"us-ky/krs-48.620","next":"us-ky/krs-48.700"},"notice":"GroundRules: Original legal text.
