{"data":{"id":"us-ky/krs-49.010","jurisdiction":"us-ky","citation":"KRS 49.010","heading":"Office of Claims and Appeals -- Administrative boards within office --","body":"Executive director -- Powers and duties -- Crime Victims Compensation Board\n-- Trauma-informed training -- Requirement.\n(1) The Office of Claims and Appeals is created with in the Public Protection Cabinet\nand shall constitute a statutory administrative office of the state government within\nthe meaning of KRS Chapter 12.\n(2) The Office of Claims and Appeals shall consist of three (3) separate and distinct\nadministrative boards attached to the office within the meaning of KRS 12.020:\n(a) The Board of Tax Appeals;\n(b) The Board of Claims; and\n(c) The Crime Victims Compensation Board.\n(3) The executive director of the Office of Claims and Appeals shall be appointed by\nthe secretary of the Public Protection Cabinet with the approval of the Governor in\naccordance with KRS 12.050. The secretary of the Public Protection Cabinet is the\nappointing authority for the Office of Claims and Appeals, and the executive\ndirector shall be direct ly responsible to the secretary of the Public Protection\nCabinet and shall perform the functions, powers, and duties provided by law and\nprescribed by the secretary of the Public Protection Cabinet. The executive director\nshall:\n(a) Carry out the policy and program directives of the boards;\n(b) Be responsible for the day-to-day operations of the office;\n(c) Establish appropriate organizational structures and personnel policies;\n(d) Prepare annual reports on the office's and boards' activities;\n(e) Prepare budgets;\n(f) Perform all other duties as directed by the secretary and the boards and\nnecessary for the operations of the office; and\n(g) Keep written records documenting the completion of training by staff for and\nmembers of the Crime Victims Compensation Board.\n(4) The Office of Claims and Appeals shall be authorized to:\n(a) Employ necessary staff, secure adequate office space, and execute other\nadministrative and logistical matters as may be necessary to ensure proper\nfunctioning of the office;\n(b) Promulgate, amend, and repeal suitable administrative regulations to carry out\nthe provisions and purposes of the office's statutory authority;\n(c) Publicize widely the functions and purposes of the Office of Claims and\nAppeals and its attached boards;\n(d) Enter into agreements with any state agency, political subdivision of the state,\npostsecondary education institution, or other person or entity to enlist\nassistance to implement the duties and responsibilities of the office; and\n(e) Ensure that staff for the Crime Victims Compensation Board receives trauma -\ninformed training to understand the challenges faced by victims of crime,\nincluding factors that may result in the delayed filing of a claim. Staff shall\nreceive six (6) hours of training under this paragraph within thirty (30) days of\nbeing hired, and three (3) hours of training each year thereafter. Training\npursuant to this paragraph may be developed in collaboration with\norganizations and agencies that specialize in victim services and victim\nadvocacy.\n(5) The principal office of the Office of Claims and Appeals shall be at Frankfort,\nKentucky, and shall be open during regular working hours for the conduct of its\nbusiness.","path":["KRS Chapter 49"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52752","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:09Z","sha256":"f92731b5a0609e729c4970ff8213bea2e5e436753de577b868f784222e57c2ad","source_id":"us-ky","stale":false,"prev":"us-ky/krs-48.960","next":"us-ky/krs-49.020"},"notice":"GroundRules: Original legal text.
