{"data":{"id":"us-ky/krs-49.050","jurisdiction":"us-ky","citation":"KRS 49.050","heading":"Jurisdiction of Board of Claims as to municipal maintenance of state -owned","body":"traffic control devices.\n(1) The Board of Claims created by KRS 49.010 is hereby vested with full power,\nauthority, and jurisdiction to investigate, hear proof, and com pensate persons for\ndamages sustained to either person or property as a proximate result of negligence\non the part of any municipality, or any of its officers, agents, or employees while\nacting within the scope of their employment by the municipality, or a ny agency\nthereof, relating to the maintenance by the municipality of state -owned traffic\ncontrol devices pursuant to a contract with the Commonwealth.\n(2) Claims for personal injury or property damage against any municipality, or any of\nits officers, agents, or employees while acting within the scope of their employment\nof the municipality, arising out of negligence in the maintenance of state -owned\ntraffic control devices pursuant to a contract with the Commonwealth, shall be\nlimited and reduced in the same manner as described in KRS 49.040 with respect to\nclaims against the Commonwealth.\n(3) It is the intention of subsections (1) and (2) of this section to provide every\nmunicipality and agency thereof, and their respective officers, agents, or employees\nwith the same liability protection, restrictions, and reductions when such\nmunicipalities and agencies are performing maintenance on state -owned traffic\ncontrol devices pursuant to a contract with the Commonwealth as the\nCommonwealth and its agencies, officers, and employees would enjoy if performing\nthe work itself.","path":["KRS Chapter 49"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51454","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:09Z","sha256":"a7137dbe765cde3ffbd03d175e07dd6e0b86a0dab79e9b6b5f759836d22932a0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-49.040","next":"us-ky/krs-49.060"},"notice":"GroundRules: Original legal text.
