{"data":{"id":"us-ky/krs-49.390","jurisdiction":"us-ky","citation":"KRS 49.390","heading":"Reduction of award -- Basis of denial, reconsideration, or reduction of","body":"award.\n(1) Any award made pursuant to KRS 49.270 to 49.490 shall be reduced by the amount\nof any payments received or to be received by the claimant as a result of the  injury\nfrom the following sources:\n(a) From or on behalf of the person who committed the crime;\n(b) Under insurance programs mandated by law;\n(c) From public funds;\n(d) Under any contract of insurance wherein the claimant is the insured or\nbeneficiary;\n(e) As an emergency award pursuant to KRS 49.360; and\n(f) From donations made on behalf of the victim or claimant toward expenses\nincurred as a result of the crime.\n(2) The board may deny, reconsider, or reduce an award if the board finds that, in\nrelation t o the criminally injurious conduct alleged in the claim, the victim or\nclaimant:\n(a) Has been charged with a criminal offense;\n(b) Has been offered immunity from prosecution in exchange for testimony;\n(c) Knowingly participated in the conduct; or\n(d) Engaged in conduct which may constitute mutual aggression with another\nperson.","path":["KRS Chapter 49"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54915","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:10Z","sha256":"efad21b9d5cf6a1ac5d774587cf58c13113e8fa6559a79449fa365457d5f92d7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-49.380","next":"us-ky/krs-49.400"},"notice":"GroundRules: Original legal text.
