{"data":{"id":"us-ky/krs-49.450","jurisdiction":"us-ky","citation":"KRS 49.450","heading":"Contracts regarding crime -- Money to be paid to Crime Victims","body":"Compensation Board -- Disposition.\n(1) Every person contracting with any person or the representative or assignee of any\nperson accused or convicted of a crime in this state, with respect to the reenactment\nof such crime, by way of a movie, book, magazine article, radio, or television\npresentation, live entertainment of any kind, or from the expression of such person's\nthoughts, feelings, opinions, or emotions regarding such crime, shall pay over to the\nCrime Victims Compensation Board any moneys which would otherwise, by terms\nof such contract, be owing to the person so accused or convicted or his\nrepresentatives.\n(2) After deducting all sums paid to the victim by the board, the boa rd shall deposit\nsuch moneys in its accounts for the benefit of and payable to any victim of crimes\ncommitted by such person, provided that such person is eventually convicted of the\ncrime and provided further that such victim, within five (5) years of the  date of the\ncrime, brings a civil action in a court of competent jurisdiction and recovers a\nmoney judgment against such person or his or her representatives.\n(3) Upon disposition of charges favorable to any person accused of committing a crime,\nor upon a showing by such person that five (5) years have elapsed from the board's\nreceipt of such funds and that such person has not been convicted of said crime and\nfurther that no actions are pending against such person in connection with the crime\nor pursuant to this section, the board shall immediately pay over any such moneys to\nsuch person.\n(4) Notwithstanding any inconsistent provision of the civil practice law and rules with\nrespect to the timely bringing of an action, the five (5) year period provided for in\nsubsection (2) of this section shall not begin to run until the board has received such\nmoneys.\n(5) Any action taken by any person convicted of a crime, whether by way of execution\nof a power of attorney, creation of corporate entities, or otherwise, to  defeat the\npurpose of this section shall be null and void as against the public policy of this\nstate.\n(6) The failure of a person to pay moneys to the board in accordance with subsection\n(1) of this section shall create a debt due and owing to the board f rom that person\nand shall constitute a preferential lien to the state which may be collected by the\nboard by civil process.","path":["KRS Chapter 49"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51490","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:10Z","sha256":"56c39b6582ccf794bcbc0d191ea81533a03a1f6ab84c1bd112566fcc0a1b9beb","source_id":"us-ky","stale":false,"prev":"us-ky/krs-49.440","next":"us-ky/krs-49.460"},"notice":"GroundRules: Original legal text.
