{"data":{"id":"us-ky/krs-49.460","jurisdiction":"us-ky","citation":"KRS 49.460","heading":"Subrogation.","body":"(1) No right of action at law against a person who has committed a criminal act for\ndamages as a consequence of such act shall be lost as a consequence of receiving\nbenefits under the provisions of KRS 49.270 to 49.490. In the event any person\nreceiving benefi ts under KRS 49.270 to 49.490 additionally seeks a remedy for\ndamages from the person or persons who have committed the criminal act resulting\nin damages, then and in that event the Crime Victims Compensation Board shall be\nsubrogated to and have a lien up on any recovery so made to the extent of the\npayments made by the state to or on behalf of such person under KRS 49.270 to\n49.490.\n(2) If compensation is awarded, the state is subrogated to all the claimant's rights to\nreceive or recover benefits or advant ages, for economic loss for which and to the\nextent only that compensation is awarded from a source which is, or, if readily\navailable to the victim or claimant would be, a collateral source.","path":["KRS Chapter 49"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51491","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:10Z","sha256":"f5b27b55bd57939dc7ccdf1ce11827c92b94eadd45b2e5987fbfbb133e33e211","source_id":"us-ky","stale":false,"prev":"us-ky/krs-49.450","next":"us-ky/krs-49.470"},"notice":"GroundRules: Original legal text.
