{"data":{"id":"us-ky/krs-49.490","jurisdiction":"us-ky","citation":"KRS 49.490","heading":"Sexual assault victim assistance fund.","body":"(1) There is established in the State Treasury the sexual assault victim assistance fund\nto be administered by the Crime Victims Compensation Board for the purpose of\nfunding medical examinations for victims of sexual assault as provided in\nsubsection (4) of t his section and in KRS 216B.400. All moneys deposited or paid\ninto the sexual assault victim assistance fund are appropriated and shall be available\nto the board. Funds shall be disbursed by the State Treasurer upon the warrant of the\nboard.\n(2) The sexual  assault victim assistance fund may receive state general fund\nappropriations, gifts, grants, federal funds, or other public or private funds or\ndonations. Any federal matching funds received by the board or the crime victims'\ncompensation fund for sexual assault victim assistance payments shall be deposited\ninto the sexual assault victim assistance fund.\n(3) Any unencumbered or unallocated balances in the sexual assault victim assistance\nfund shall be invested as provided in KRS 42.500(9). Any income earne d from\ninvestment, along with the unallocated or unencumbered balances in the fund, shall\nnot lapse and shall be deemed a trust and agency account available solely for the\npurposes specified in subsection (1) of this section.\n(4) (a) For purposes of this section, a children's advocacy center is a center as defined\nin KRS 620.020 that operates consistent with administrative regulations\npromulgated by the Cabinet for Health and Family Services.\n(b) Upon receipt of a completed original claim form supplied by t he board and\nitemized bill for a child sexual abuse medical examination performed at a\nchildren's advocacy center, the board shall reimburse the children's advocacy\ncenter for actual costs up to but not exceeding the amount of reimbursement\nestablished through administrative regulation promulgated by the Department\nfor Medicaid Services.\n(c) Independent investigation by the board shall not be required for payment of\nclaims under this section; however, the board may require additional\ndocumentation as proof that the medical examination was performed.\n(5) If sexual assault victim assistance funds are insufficient to pay claims under\nsubsection (4) of this section or KRS 216B.400, payment shall be made from the\ncrime victims' compensation fund.","path":["KRS Chapter 49"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51493","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:10Z","sha256":"14b08ce41e88a7f03b5d3852c95f422b066da3cae1a41fd1c418e883e8d3c783","source_id":"us-ky","stale":false,"prev":"us-ky/krs-49.480","next":"us-ky/krs-49.990"},"notice":"GroundRules: Original legal text.
