{"data":{"id":"us-ky/krs-500.092","jurisdiction":"us-ky","citation":"KRS 500.092","heading":"Forfeiture of personal property not used as a residence triggered by","body":"violation or attempted violation of certain offenses -- Forfeiture of real and\npersonal property associated with violation or attempted violation of KRS\n531.310 or 531.320.\n(1) (a) Notwithstanding KRS 500.090, all personal property which is not used as a\npermanent residence in this state which is used in connection with or acquired\nas a result of a violation or attempted violation of any of the statutes set out in\nsubsection (3) of this section shall be subject to forfeiture under the same\nterms, conditions, and defenses and using the same process as set out in KRS\n218A.405 to 218A.460 for property subject to forfeiture under that chapter.\n(b) Notwithstanding KRS 500.090, al l real and personal property in this state\nwhich is used in connection with or acquired as a result of a violation or\nattempted violation of KRS 531.310 or 531.320 shall be subject to forfeiture\nunder the same terms, conditions, and defenses and using the same process as\nset out in KRS 218A.405 to 218A.460 for property subject to forfeiture under\nthat chapter.\n(2) Administrative regulations promulgated under KRS 218A.420 shall govern\nexpenditures derived from forfeitures under this section to the same exten t that they\ngovern expenditures from forfeitures under KRS 218A.405 to 218A.460.\n(3) The following offenses may trigger forfeiture of personal property under subsection\n(1)(a) of this section:\n(a) KRS 17.546;\n(b) KRS 508.130 involving the use of any equipm ent, instrument, machine, or\nother device by which communication or information is transmitted, including\ncomputers, the internet or other electronic network, cameras or other\nrecording devices, telephones or other personal communications devices,\nscanners or other copying devices, and any device that enables the use of a\ntransmitting device;\n(c) KRS 510.155;\n(d) KRS 530.064(1)(a);\n(e) KRS 531.030;\n(f) KRS 531.040\n(g) KRS 531.310;\n(h) KRS 531.320;\n(i) KRS 531.335;\n(j) KRS 531.340;\n(k) KRS 531.350;\n(l) KRS 531.360; and\n(m) KRS 531.370.","path":["KRS Chapter 500"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57444","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:59Z","sha256":"438959f8b0ffb692c24ae7fc99c7beadaec700cd2049653f1446f49d4f86e176","source_id":"us-ky","stale":false,"prev":"us-ky/krs-500.090","next":"us-ky/krs-500.093"},"notice":"GroundRules: Original legal text.
